Field 91A, Belle Vue (Lesquende), Phase 1: Proposed lease of land to the JEC

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

REPORT TO THE HOUSING MINISTER

 

PROPOSED LEASE OF LAND TO THE JERSEY ELECTRICITY COMPANY AT FIELD 91A BELLE VUE (LESQUENDE), PHASE 1, ST BRELADE, JERSEY.

 

 

Purpose

 

To lease an area of land to the JEC for a new higher capacity substation.  To amend the lease for the existing substation and return the area back to the public.

 

 

 

Background

 

The existing substation on the Belle Vue site is not of sufficient capacity to meet the electrical demand from the 35 new properties in phase 1.  To satisfy the additional electrical demand a new larger capacity substation is required and this will need to be built in a separate location on the site, commissioned and working before the existing substation is decommissioned and removed. 

 

The new substation will require a new 99 year lease at a cost of £990.00.  The existing substation is included in a lease of 2 substations and 2 section pillars. This lease will need to be amended to release the existing substation site back to the public when it has been decommissioned.

 

On the 8th January 2013 the Minister approved the budget transfer of funds for a new substation and to divert electric cables.  It is proposed that the public lease the proposed new substation site as depicted on the attached drawings (SoJ plan ref 10455:EW02, JEC site plan ref 7-D24-2 and Wayleave Plan No. 9J) to the JEC for a period of 99years for a one-off consideration of £990.00 payable when the lease is engrossed, the JEC will require a way-leave agreement for the substation.  To amend the existing lease for the existing substation to release the land back to the public once the old substation has been decommissioned and removed.

 

 

 

Recommendation

 

That the Minister:-

 

  1. approve the lease of the land as depicted on the attached site plan to the JEC for 99 years for a one-off consideration of £990.00

 

  1. request that the Treasury & Resources Minister approve the transaction in accordance with Standing Order 168,  seek the approval of the States for the transaction and authorises the Greffier and Attorney General to sign the necessary contracts on behalf of the Public

 

  1. approve the amendment to the lease for the existing substation to allow the area of land to be returned to the public

 

  1. request that the Treasury & Resources Minister approve the transaction in accordance with Standing Order 168,  seek the approval of the States for the transaction and authorises the Greffier and Attorney General to sign the necessary contracts on behalf of the Public
