Royal Court and Stamp Duties and Fees (Jersey) Amendment Law 202-

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):

The Minister for Treasury and Resources decided to lodge 'au Greffe' the Draft Royal Court and Stamp Duties and Fees (Jersey) Amendment Law 202- (the Draft Law). The Draft Law, if adopted by the States Assembly, would amend the Royal Court (Jersey) Law 1948 and the Stamp Duties and Fees (Jersey) Law 1998 (the 1998 Law).

Reason for Decision(s):

The Draft Law would, if adopted by the States Assembly:  a) Abolish Jurats Stamps by repealing the Loi (1938) sur les honoraires des Jurés-Justiciers; b) Create an obligation on the Bailiff and the Treasury and Exchequer to fund the annual honoraria for Jurats from public expenditure; c) Uprate the Judicial fees, fees in matrimonial proceedings and probate fees contained in the 1998 Law in line with inflation; d) Modernise the definition of 'stamp' in the 1998 Law to reflect the abolition of physical (pre-paid) stamps; e) Create an obligation on the Bailiff and the Minister for Treasury and Resources to review the duties/fees in the 1998 Law annually, having consulted the Judicial Greffier and the Viscount; f) Extend the power to amend court fees by Order to the Minister for Treasury and Resources;  g) Create a new rate 'Q' in Schedule One of the 1998 Law for proceedings involving costs exceeding £10 million; and h) Specify that judicial fees in Schedule One of the 1998 Law are to be made routinely non-refundable.

Action Required: The Greffier of the States to lodge 'au Greffe' the Draft Royal Court and Stamp Duties and Fees (Jersey) Amendment Law 202-, with a request for debate in the States sitting which is scheduled to commence on 12th November 2024.
