Road Traffic (Trinity) (Jersey) Order 1988: Amendment: Law Drafting Instructions

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

AMENDMENT TO ROAD TRAFFIC (TRINITY) (JERSEY) ORDER 1988

 

 

Purpose of the Report

 

To amend the Road Traffic (Trinity) (Jersey) Order 1988.

 

 

Background

 

The Connétable of Trinity has requested a new area of prohibition of waiting be introduced on two 2 by-roads adjacent to Trinity Primary School.

 

The Road Traffic (Trinity) (Jersey) Order 1988 is administered by Infrastructure, Housing and Environment.

 

 

Discussion

 

The Connétable of Trinity has requested some new areas of prohibition of waiting on Les Ruelles and La Rue du Mont Pellier in the area adjacent to Trinity Primary School where there is a history of parking which causes danger to parents dropping off or collecting their children at the school. Currently the Honorary Police have a large number of temporary no waiting cones in place to try and control this practice. Having the area designated formally as an area of prohibition of waiting will assist the Honorary Police to effectively manage the parking there and thus improve safety for parents and children from the school.

 

Les Ruelles

  • Add to Schedule 2 after the entry for Les Charriѐres du Boulay “Les Ruelles (both sides between its junction with La Route de la Trinite and its junction with La Rue du Mont Pellier)”
  • Add to Schedule 2 after the entry for La Rue de la Garenne “La Rue du Mont Pellier (both sides from a point 20 yards north of its junction with Les Ruelles to a point 20 yards south of its junction with Les Ruelles)”

 

Conclusion

 

The requested areas of prohibition of waiting will enable the Honorary Police of Trinity to police dangerous parking in this area and improve safety for the children attending the primary school. This also supports the Government policy of “Putting Children First”.

 

 

Recommendations

 

The Minister for Infrastructure is recommended to instruct Officers to issue Law Drafting instructions to amend the Road Traffic (Trinity) (Jersey) Order 1988.
