Public land adjoining 162 Clos des Sables, St Brelade: Proposed Sale

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s): 

  1. The Minister approved, as recommended by Jersey Property Holdings, the sale to Mr Lyndon Thomas Renault of approximately 450 sq ft of Public land adjoining the east gable of his property 162 Clos des Sables for £35,000, with each party to pay its own fees in connection with passing contract.

Reason(s) for Decision: 

  1. Under Standing Order 168 (1) (a) the Minister hereby notified the States that he had accepted the recommendation of Jersey Property Holdings to agree to the above land transaction.

 

  1. Under Standing Order 168 (5) the Minister hereby authorised the Attorney General and the Greffier to pass any contract which is required to be passed on behalf of the Public.

Resource Implications: 

  1. There are no financial or manpower implications associated with this decision.

Action required: 

  1. In accordance with Standing Order 168 (3) this decision must be presented to the States at least 15 working days before the contract is passed.  After the expiry of 15 working days following presentation to the States the transaction may be concluded.

 

  1. The Director of Jersey Property Holdings is to instruct the Attorney General and the Greffier to pass the necessary contract and to copy this decision to the Minister, Treasurer and Deputy Treasurer.

Purpose of report  

To seek Ministerial approval to sell approximately 450 sq ft of land adjoining 162 Clos des Sables to Mr L T Renault for £35,000. 

Previous approvals  

  1. MD-PH-2009-0051 of 06 August 2009 - in-principle decision to sell approximately 450 sq ft of land adjoining 162 Clos des Sables to Mr L T Renault.

 

  1. P117/2009 – ‘2010 Annual Business Plan’, which included as part of the ‘Property Plan’ the proposal to sell approximately 450 sq ft of land adjoining 162 Clos des Sables.

 

Background 

162 Clos des Sables is a 1960s end of terrace house (see attached location plan) with an area of Public land adjoining its east gable. The dwelling is owned by Mr Lyndon Thomas Renault. 

Mr Renault approached Jersey Property Holdings in 2009 with a request to purchase an area of land to extend his house to provide a separate lounge and bedroom for his daughter. The area of land is approximately 450 sq ft and is laid to grass.  

Due to the location of the land adjoining Mr Renault’s house, it could not practically be offered for sale on the open market. In Jersey Property Holding’s opinion, the land is not significant to the overall communal landscaping at Clos des Sables, and is minded to recommend to the Minister that the land be sold to Mr Renault.  

An independent market valuation of the land has been obtained from Reynolds Chartered Surveyors which advises a value of £35,000. Mr Renault is agreeable to purchase the land for that sum and Jersey Property Holdings is minded to agree that Reynolds’ valuation is a fair and proper price. 

Following the Minister’s in-principle decision sell the land (MD-PH-2009-0051 - 06 August 2009) Mr Renault obtained planning consent for the proposed extension to his house on 21 December 2009. Mr Renault therefore now wishes to proceed with the purchase of the land with a view to completing the extension to his house in 2010. 

As the design of the extension has not changed from the original concept, and no material conditions are attached to the Planning consent, it is considered that the proposed sale price of £35,000 should still stand. 

The sale of the land to Mr Renault would be subject to use only as a domestic extension and subject to the land never being sold off seperately from the existing house. 

Recommendation 

It is recommended that the Minister agrees to sell to Mr Lyndon Thomas Renault approximately 450 sq ft of Public land adjoining the east gable of his property 162 Clos des Sables for £35,000, with each party to pay it owns fees in connection with passing contract.
