Information about the publication of Ministerial Decisions

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision
providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s): The Minister approved the in principle request to carry forward the unspent 2015 balance of £893,000 from the Restructuring Provision Public Sector Reform (PSR) revenue budget in the Chief Minister’s Department to fund the ongoing work in 2016.
Reason(s) for Decision: Article 18(3A) of the Public Finances (Jersey) Law 2005 states that The Minister may approve the withdrawal from the consolidated fund, after the end of the relevant financial year, of all or part of the amount appropriated by a revenue head of expenditure.
Resource Implications: The amount of carry forward for these purposes will be limited to £893,000 and will not exceed any underspend achieved by PSR within the Chief Minister’s Department.
Action required: The Head of Decision Support to inform the Finance Director, Corporate Group and the Head of Financial Performance that this decision is approved.

APPROVAL IN PRINCIPLE of the restructuring provision CARRY FORWARD for PSR

Purpose of Report

To approve in principle the carry forward of unspent 2015 Restructuring Provision Public Sector Reform (PSR) revenue budget in the Chief Minister’s Department (CMD) to fund the ongoing work in 2016.

Background

The Chief Minister’s Department (CMD) has identified an underspend in the 2015 allocation from the Restructuring Provision of £893,000, mostly due to a delay in the job evaluation process following setbacks in the Job Information Template (JIT) process and the knock on effect to the Performance Management project.

An agreement in principle was reached, at the Political Oversight Group meeting for PSR, that any underspend from the Restructuring Provision relating to PSR could be carried forward to 2016 in order to partially fund the ongoing projects detailed below.

Workforce Modernisation (WM) - £608,300

WM was initiated as a PSR workstream at the outset in March 2013 and the Council of Ministers approved budgets for 2013/14. In March 2014, a further tranche of funding for 2015 was approved with some indication of requirements stretching into MTFP2. Agreement to utilise the carry forward will reduce the amount required from the 2016 Restructuring Provision and will allow greater flexibility for bids submitted by other departments.

Engagement - £18,800

Ongoing funding is required to support engagement through PSR. The feedback from Shaping Our Future showed the importance of good, timely information and engagement during a period of change. Agreement to utilise the carry forward will reduce the funding request for campaigns and staff events, and the implementation of ‘Newsweaver’, an internal communications software, throughout the organisation to facilitate communication and an organisation-wide engagement survey. The reduction in the funding requirement will allow greater flexibility for bids submitted by other departments.

Leadership Development - £91,000

A growth bid for Leadership Development was unsuccessful in MTFP2 so ongoing interim funding is required to maintain and enhance the current programme. Funding provides for maintaining the momentum from the investment already made during the first phase of PSR (for executive and senior leadership development, continue Virtual Ashridge and for Middle Manager events) together with a Transformational Leadership Programme for managers across the States.

Lean - £19,600

This funding request will sustain Lean across the organisation and, although the aim is for Lean to be self-sustaining, funding is still required to provide ongoing Lean skills development, Lean leadership development, reactivating current practitioners and Lean co-ordinator/resource.

PSR Portfolio Management Office - £155,300

To assist with the setting up of a fit-for-purpose Portfolio Management Office within the Chief Minister’s Department to support the delivery of the Public Sector Reform Programme.

3. Recommendation

That the Minister for Treasury and Resources approves the in principle request to carry forward the unspent 2015 balance of £893,000 from the Restructuring Provision Public Sector Reform (PSR) revenue budget in the Chief Minister’s Department to fund the ongoing work in 2016.
