Former Le Coin flats site and Curry's warehouse: Transfer of land and rights

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

FORMER ‘LE COIN FLATS’ SITE & ‘CURRY’S WAREHOUSE’

TRANSFER OF LAND AND RIGHTS

 

Purpose

To agree proposals for the gift, cession and transfer of land at the former Le Coin site in order to facilitate development.

Background

The Minister will recall that on 15th November 2013 he agreed to accept tendered proposals for the development of the former Le Coin Site.  (MD-H-2013-0088 refers).

 

The Le Coin site shares part of its western boundary with land comprising a warehouse known as ‘Curry’s Warehouse’ bearing the numbers 14-18 Charles Street owned by Mrs Margaret Elizabeth Bazire.

 

The boundary itself comprises a party owned granite wall which forms the gable of 14-18 Charles Street. This wall is bowed at its center.  Initially it was proposed to construct the wall of the new apartment block against this existing party wall, however, this would have led to the creation of a void space between the new apartment block and the wall.  During site surveys, it was also noted that the existing wall would require significant maintenance prior to the development to ensure its structural integrity.  It was therefore considered that the best overall solution would be to remove the existing wall and construct the new apartment block up to the boundary which would be straightened out in the process.  This will require the gift, cession and transfer of a small strip of land (shown hatched in blue on the plan attached at annex a hereto) by the public to Mrs Bazire, who will, in turn, grant the public rights of access across her property for the future maintenance of the new apartment, in perpetuity. The transfer of the land and the granting of these rights are to be formalised in contract to be passed in the Royal Court.

 

The land to be transferred is valued at £100.

 

The cost of the demolition of the wall has already been included in the existing fixed price contract. It has been agreed that all reasonable legal fees and other expenses incurred by Mrs Bazire in respect of the proposed contract will be met by the Department, from within the approved project budget.

 

Recommendations

 

That the Minister;

 

  1. Approve the proposals for the gift, cession and transfer of land at the former Le Coin site, by the Public to Mrs Bazire together with the granting of rights to the Pubic by Mrs Bazire, all in accordance with Standing Order 168 (1) (a) & (b);

 

  1. Request that the Treasury & Resources Minister (i) approve the transaction under Standing Order 168(2) and (ii) authorise the Greffier and Attorney General to pass the necessary contract on behalf of the Public before the Royal Court under Standing Order 168 (5).
