A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Variation of Condition 2 from Planning Permit P/2009/1092 to remove 50% ‘Homebuy Scheme’ requirement and reclassify as ‘First time buyers’ qualifying under the Housing Department’s regulations.

Decision(s):

The Minister for Planning and Environment has agreed to vary Condition 2 from Planning Permit P/2009/1092 to remove the 50% ‘Homebuy Scheme’ requirement, to be reclassified as ‘First time’ buyers.

 

The amendment was agreed following discussions and legal advice received by the Minister on the 27th October 2011 regarding the inability of the States Assembly to provide a suitable mechanism to deliver the ‘Homebuy Scheme’.

Reason(s) for Decision:

This decision has been reached so that the development of ten new houses can be delivered unencumbered by a Condition which has, in light of the States Assembly’s outcome, no validity and therefore cannot be delivered as was originally intended.  Further, the site remains within the Built-Up Area as defined by the Island Plan, 2011.  Policy H6 outlines the Plan’s intention to deliver the majority of the Island’s housing supply from development within the Built-Up Areas. Therefore, notwithstanding the sites previous Category ‘A’ status under the current Island Plan the site remains a viable development site capable of delivering ‘first time’ buyer housing.

 

The Condition on the Revised Plans Application RC/2011/1332 will read:-

 

Condtion 1.    The development permitted under Planning Permission reference P/2009/1092, for ten new dwellings, shall only be sold to first time buyers qualifying under the Housing Department regulations and may only be sold on thereafter in perpetuity to persons qualifying in the same manner.  All other Conditions and restrictions imposed by Planning Permission P/2009/1092 remain valid.

Reason 1.       To ensure that the development is carried out and completed in accordance with the detials approved by the Minister for Planning and Environment to accord with Policies GD1 & H6 of the Island Plan, 2011.
