Road Traffic (Public Parking Places) (Jersey) Order 2006: Law drafting instructions to add Les Jardins Car Park

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

AMENDMENT TO ROAD TRAFFIC (PUBLIC PARKING PLACES)

 

 (JERSEY) ORDER 2006

 

 

Purpose of the Report

 

To introduce Les Jardins Car Park with a maximum stay period of seven consecutive days.

 

 

Background

 

The States of Jersey Development Company (SoJDC) has now received approval to start work on developing the existing Esplanade Car Park site to create a new financial district. As a result of this, the Esplanade Car Park will close and be replaced for the duration of the works by a new temporary car park on the Waterfront which will be called Les Jardins Car Park. The existing Esplanade Car Park is currently leased to Transport and Technical Services Department by SoJDC who own the land. The Les Jardins Car Park will be leased to Transport and Technical Services on the same lease basis as Esplanade Car Park.

 

There is a planning requirement for SoJDC to provide a temporary site for a replacement car park whilst the development work is undertaken.

 

The creation of the temporary Les Jardins Car Park will ensure the continued provision of the currently available spaces provided by the Esplanade Car Park for the period of the development. SoJDC are meeting the costs of preparing Les Jardins Car Park for use as a temporary car park.

 

The request to include the new car park with maximum stay period will enable enforcement of the area to be undertaken by the Department’s Parking Control Officers.

 

Parking within the new car park will be chargeable at the rate of 1 unit per hour or part thereof and Season Tickets will be valid.

 

Les Jardins Car Park is scheduled to open in April 2014 with the closure of Esplanade Car Park at the same time.

 

The Road Traffic (Public Parking Places) (Jersey) Order 2006 is administered by the Transport and Technical Services Department.

 

 

Discussion

 

Officers support the introduction of this car park with the maximum stay period detailed. The policing and enforcement of this would be carried out by Parking Control Officers employed by Transport and Technical Services Department.

 

 

 

 

Recommendations

 

The Minister is recommended to approve the addition of Les Jardins Car Park and to request Officers to instruct the Law Draftsman to prepare an Amendment to the Road Traffic (Public Parking Places) (Jersey) Order 2006 to incorporate this.
