Criminal Justice (Young Offenders) (Placement Panel) (Jersey) Regulations 2016: Appointment of members

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject:  Criminal Justice (Young Offenders) (Placement Panel) (Jersey) Regulations 2016: Appointment of Placement Panel members.

 

Decision(s):  

The Minister for Home Affairs decided to appoint two new representatives to the Children and Young Person’s Placement Panel established under Art 2 (3) (b) of the Criminal Justice (Young Offenders) (Placement Panel) (Jersey) Regulations 2016. The two representatives will be the Manager of Greenfields and the Lead Nurse at the Child and Adolescent Mental Health Service (CAMHS).

 

Reason(s) for Decision: In November 2016, the States Assembly adopted the Criminal Justice (Young Offenders) (Placement Panel) (Jersey) Regulations 2016. Under those Regulations, the Minister must appoint between five to ten members of the Placement Panel. The function of the Panel, as set out in the Criminal Justice (Young Offenders) (Jersey) Law 2014 is to:

(a)   determine the appropriate place of custody for a child or young person to serve a sentence of detention or to be remanded in custody;

(b)   to review its decision concerning its placement of a child or young person.

 

In accordance with the Regulations:

  1. the Panel will have 5 to 10 members appointed by the Minister for Home Affairs, and
  2. those Members will be either:

(a)          probation officers

(b)          employees of the education department

(c)           employees of the health and social services

(d)          any other person whom the Minister deems appropriate having regard to the person’s knowledge and experience.

 

The Panel is known as the Children and Young Person’s Placement Panel.

 

Resource Implications: It is not anticipated that there will be any requirement for additional resources associated with these appointments. The costs associated with the running of the Placement Panel will be met from within existing resources.
