Warren Farm, St. Peter - maintain as building of local interest

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):

The Minister for Planning and Environment determined that Warren Farm, Beaumont, St Peter be maintained on the Register of Buildings and Sites of Architectural, Archaeological and Historical Importance in Jersey as a Building of Local Interest.

Reason(s) for Decision:

  1. The particular interest of Warren Farm, Beaumont, St Peter, as identified and described in the report and relative to the published criteria for selection, justifies its inclusion on Register of Buildings and Sites of Architectural, Archaeological and Historical Importance in Jersey as a BLI and;
  2. it accords with the States Strategic Plan commitment of protecting and enhancing the Island’s built heritage assets.

Legal and Resource Implications:

The inclusion of buildings and places in the Register of Buildings and Sites of Architectural, Archaeological and Historical Importance in Jersey is consistent with the purposes of the Planning and Building (Jersey) Law 2002.

Purpose of the Report

To enable the Minister to consider his intention to maintain Warren Farm, Beaumont, St Peter as a Building of Local Interest (BLI) on the Register of Buildings and Sites of Architectural, Archaeological and Historical Importance in Jersey. 

Background and discussion

The Minister previously considered a report on the matter prepared by Jersey Heritage dated 25 September 2009 recommending that the building be removed from the Register. 

The Minister, having considered the views of JHT and also of the Ministerial Registration and Listing Group (MRLAG) which was marginally in favour of retaining the building on the register (5:4) determined that Warren Farm, Beaumont, St Peter was of sufficient interest to warrant its maintenance on the Register of Buildings and Sites of Architectural, Archaeological and Historical Importance. Notice of the Minister’s intent was served in order to provide an opportunity for representations to be made. 

A representation has been received in relation to the intention to maintain Warren Farm, Beaumont, St Peter on the Register as a BLI dated 03 November 2009 and is attached as an appendix. 

Many points are raised some of which relate to the current condition of the building and its development potential and future use, which are not germane to any consideration of whether the building has local interest worthy of maintaining it on the Register. 

The representation does submit, however, that the building is ‘undistinguished and of marginal interest…much altered,…. and no longer an accurate representation of Jersey vernacular architecture’. 

Legal and resource implications

The inclusion of buildings and places in the Register of Buildings and Sites of Architectural, Archaeological and Historical Importance in Jersey is consistent with the purposes of the Planning and Building (Jersey) Law 2002. 

Recommendation

The recommendation of Jersey Heritage is not to maintain Warren Farm, Beaumont, St Peter on the Register of Buildings and Sites of Architectural, Archaeological and Historical Importance in Jersey as a Building of Local Interest. 

Reason(s) for Recommendation

The particular interest of Warren Farm, Beaumont, St Peter, as identified and described in the report and relative to the published criteria for selection, does not justify its inclusion on Register of Buildings and Sites of Architectural, Archaeological and Historical Importance in Jersey as a BLI
