Consultation Starts for New Law to Protect Consumers

A new law which could greatly improve consumer protection for people buying goods in Jersey has been put forward by the Minister for Economic Development. A three month consultation period for the draft Supply of Goods and Services Law starts today.

The Law will give consumers clear “statutory rights” which are often referred to in statements accompanying goods but which actually relate to the UK Sale of Goods Act.

As a result, Jersey’s draft law is based on similar principles to the Sale of Goods Act and other statutes which help establish the rights of consumers and the responsibilities of traders in everyday transactions.

The key provisions of the draft introduce familiar terms like satisfactory quality and fitness for purpose. In the case of services, consumers will know that the service supplied should be carried out with reasonable care and skill, within a reasonable time and, where a charge is not agreed, for a reasonable price.

Minister for Economic Development, Senator Philip Ozouf says “Having been on the Industries Committee (in 2001) when the “Review of Consumer Protection in Jersey” was published, I am very pleased to finally progress this important issue and to consult on what will be a major step forward in providing protection for consumers. Consumers will know that if the goods they buy turn out to be defective, it will be clear what rights they have if the trader does not deal with them in a fair and reasonable manner. This law will give the support they need in reaching a satisfactory outcome.”
