Consultation to be held on change to the Probate Law

21 October 2021

People in Jersey are being asked for their views on proposed amendments to the Probate (Jersey) Law 1998 that would provide new arrangements for the management of a deceased person's moveable estate in Jersey.

This would include items of personal property, such as cash, jewellery, clothes and furniture, where the total value is no more than £30,000

The proposed changes have been developed in response to previously expressed concerns by representatives from the care sector and other businesses about how best to manage the personal property of deceased clients.

The aim of the amendments is to allow people, such as care providers, who are holding a deceased person's personal property to release it to another person, normally a family member, who has agreed to be accountable for the estate and before a grant of probate or letters of administration.

The consultation will run until 14 December 2021. Comments are welcomed from members of the public and all other professional stakeholders.

Comments are to be submitted by email to probateconsultation@gov.je;
