Russia Sanctions: Legislation Update

1. The UK Government has updated its Russia sanctions regime through the Russia (Sanctions) (EU Exit) (Amendment) Regulations 2023 (the "Amendment Regulations"). These changes, save for Regulation 3, came into force today and are effective immediately in Jersey. Regulation 3 will come into force in the UK and Jersey on 30 September 2023.

2. The new package of internationally co-ordinated sanctions and trade measures includes export bans on every item Russia has been found using on the battlefield to date.

3. Included in the hundreds of goods are aircraft and vehicle parts, radio equipment, and electronic components that can be used by the Russian military industrial complex, including in the production of Unmanned Aerial Vehicles.

4. The UK is also introducing new major trade measures, undermining Russia's military and the country's finances. Alongside banning exports of products found used by Russia on the battlefield, the UK will also ban the import of 140 goods including iron and steel products processed in third countries.

5. The sanctions come into force today, Friday 21 April 2023, under the Russia (Sanctions) (EU Exit) Regulations 2019 (the "Russia Regulations") and are effective immediately in Jersey through the Sanctions and Asset-Freezing (Implementation of External Sanctions) (Jersey) Order 2021 (the "Sanctions Implementation Order").

Amendments

6. The Amendment Regulations cover several new trade measures as follows:

• Prohibitions on the export, supply and delivery, and making available to, or for use in Russia of a range of goods that Russia has been found using on the battlefield to date, as well as the provision of related ancillary, financial and technical services. This includes aircraft and vehicle parts, radio equipment and other electronic equipment, biotechnology, and 3D printing machinery.
• Prohibitions on the import and acquisition of additional goods originating or consigned from Russia which generate revenue for the Russian government, as well as the provision of related ancillary services. This will further constrain Russia's ability to raise money to fund its war effort.
• Extension of existing prohibitions on importing and acquiring iron and steel goods to cover the import and related ancillary services, of Russian origin goods that have been processed in third countries. This will enter into force at 00:01 on 30 September 2023 and is designed to further inflict economic cost to undermine Russia's war effort.
• An introduction of a prohibition on the supply and delivery of certain revenue generating goods from Russia to third countries. This will help disrupt Russia's exports of these goods, further constraining their ability to fund their war efforts. Revenue generating goods that have an important humanitarian use are not covered by this new prohibition. 
• Exceptions which apply to existing prohibitions, such as humanitarian assistance activity, will apply to the new goods.
