About the consultation

​The Legislation Advisory Panel would like your views on proposals to modernise and simplify the law that protects children's property rights. 

Currently, if a person under 18 years old inherits property, land or valuables, an adult (known as a tuteur) must be appointed to look after their interests. The tuteur is nominated by seven électeurs, known collectively as a tutelle.

Under the proposed new system, if a child inherits or comes to own land, property or valuables over £25,000, the Royal Court will appoint a responsible adult (tuteur) and there will no longer be a need for électeurs.

The tuteur will remain in place until the child is 18 years old and oversee the handover of the property.

The proposed changes, if approved, will make the law:

  • clearer
  • less expensive to administer
  • more suitable for modern families

It also gives more protection for the child and more flexibility for the tuteur.

The proposed changes are related to the publication of the Jersey Law Commission Topic Report No.3 the Law of Tutelles (July 2002), which highlighted a number of drawbacks in the present system.​
