About the consultation
The criminal justice system may affect everybody at some point in their lives, whether as a person suspected of committing an offence or as a victim, or a witness to a crime, or perhaps as a member of a jury.
This consultation document will briefly explain the process by which the draft law has been developed and the objectives and principles that have guided its development. It then highlights aspects of the draft law that consultees are encouraged to consider and provide written responses to.
The draft law circulated for consultation is not the finished article. The responses to this consultation will help to make sure that the draft is further developed before it's lodged before the States Assembly.
The Minister for Home Affairs intends that the draft law should be lodged before the Assembly before the end of 2017, with a view to it being debated early in 2018.
We are seeking general comments on the draft law and particular views on the following seven areas of the draft law:
-
juries
-
disclosure
-
compellability of spouses and civil partners
-
special measures
-
hearsay
-
bad character
-
trials: children and young people
Who can respond
It's important that any changes to legislation take into account a wide range of views and experience. Therefore, we would like to hear from:
-
members of the public
-
legal professionals
-
public bodies delivering criminal justice services
-
victim and witness organisations
