About the consultation
Under the Water Pollution (Jersey) Law, 2000 (‘the Law’), the Minister for the Environment has the objective, in carrying out the functions under the Law, of improving the quality of water in and around Jersey. This is to be achieved by the prevention, control, reduction and elimination of the pollution of controlled waters. “Controlled waters” include inland waters, groundwater and coastal waters.
This Law would amend the Water Pollution (Jersey) Law 2000 (the “Law”) to change the provisions with respect to water management, which are not currently in force.
The draft Amendment Law allows and simplifies the process of implementing these water management provisions in order to tackle diffuse pollution, which has been identified as a priority issue in respect of water quality in Jersey at this time.
The Amendment Law (if enacted) will mean future controls will be introduced solely by Ministerial Orders on activities that can cause diffuse pollution. The ability of the Minister to impose such controls will be subject to important safeguards including a right to make representations to a proposed Water Management Order.
