The procurement requirements for building project works are incorporated within the wider States Financial Direction 5.1 ‘Purchasing Goods and Services’. The link is provided below:

All projects that are required to be advertised for tender under the Financial Direction 5.1 are uploaded to the States e-tendering portal. Some projects may also be advertised elsewhere to target a particular contractor market. Where an exemption from open tendering is approved, the project may be tendered through a restricted process or not tendered. The reason for any variation from open tendering will be recorded in the approved exemption form.

It is not possible to break the expenditure down and quantify it as a percentage of total States expenditure for each year as it is estimated it would exceed 12.5 hours to collate the information. For this reason the Scheduled Public Authority has determined that this information falls under Article 16 of the Freedom of Information (Jersey) Law 2011 and is refused.

The information requested is not held by the States of Jersey. The information is held by the Jersey Development Company which is not a scheduled public authority under the Freedom of Information (Jersey) Law 2011. It is not information which, as the shareholder, the States of Jersey would ordinarily hold or request.

Article 16: A scheduled public authority may refuse to supply information if cost excessive

(1) A scheduled public authority that has been requested to supply information may refuse to supply the information if it estimates that the cost of doing so would exceed any fee of an amount determined in the manner prescribed by Regulations.

Regulation 2 (1) of the Freedom of Information (Costs) (Jersey) Regulations 2014 allows an authority to refuse a request for information where the estimated cost of dealing with the request would exceed the specified amount of the cost limit of £500. This is the estimated cost of one person spending 12.5 working hours in determining whether the department holds the information, locating, retrieving and extracting the information.
