Request

I would like a copy of the Alexandra Luck report about Tunnell Street and especially the shared space area which was commissioned by the States of Jersey Police as part of the prosecution against (Name withheld).

Response

The information is held but the request is refused.

A similar request was made in July this year. A link to the response given is below. The circumstances have not changed as the Inquest is yet to be finalised.

Article 36 - Court Information

Information is absolutely exempt information if it is held by a scheduled public authority only by virtue of being contained in a document-

(a) Filed with, or placed in the custody of a court.

Article 36 - Information intended for future publication

Information is qualified exempt information if, at the time when the request for information is made, the information is being held by the public authority with a view to it being published.

Article 42 - Law Enforcement

Information is qualified exempt information if its disclosure would, or would be likely to prejudice-

(c) the administration of justice, whether in Jersey or elsewhere.

Public interest test

It is in the public interest that any conclusions from the report are considered by the States of Jersey (Department for Infrastructure), the Parish of St Helier and other interested parties. The publication of a document that may have a bearing on the outcome of any associated judicial proceedings and the future inquest should not be in the public domain beforehand. It is therefore not in the public interest to release the information at this time.
