Please can you provide me with a copy of the site selection report in regards to the relocation of the hospital catering department to St Peter's Technical Park units 9 and 10.

Response

Having considered the public interest, the relevant Department's decision is to provide a redacted version of the report.

Article 26 (Information Supplied in Confidence) and Article 33 (Commercial Interests) of the Freedom of Information (Jersey) Law 2011 have been applied to the redacted report.

Exemptions applied

Article 26 Information supplied in confidence

Information is absolutely exempt information if -

(a) it was obtained by the scheduled public authority from another person (including another public authority); and

(b) the disclosure of the information to the public by the scheduled public authority holding it would constitute a breach of confidence actionable by that or any other person.

Article 33 Commercial interests

Information is qualified exempt information if -

(a) it constitutes a trade secret; or

(b) its disclosure would, or would be likely to, prejudice the commercial interests of a person (including the scheduled public authority holding the information).

Article 33 is a Qualified Exemption and is therefore subject to a Public Interest Test.

Justification for the exemption

The information is of significant commercial value and its disclosure would, or would be likely to, prejudice the commercial interests of the third party and the scheduled public authority.

However, in this instance, it has been decided that it would be in the public interest to release a redacted report.
