Request

With regard to the Rehabilitation of Offenders (Jersey) Law 2001 I would like to know the following –

A

How many times has this Law been broken over the past 10 years and how were these offences dealt with?

B

Can a States Member, member of the Police or Judiciary deliberately ignore this law and publicly disclose a persons spent conviction(s) either verbally or online?

C

Are there any recorded instances were an employer or employment agency has deliberately ignored this Law and refused to give employment to an employee?

Response

A

Our search of information we hold has found no record of any offences under the Rehabilitation of Offenders (Jersey) Law 2001. Note that we only hold records when someone is prosecuted for breaking the law.

B

This question is a request for legal advice and as such cannot be addressed in a Freedom of Information response which is limited to supplying records which we hold. The Rehabilitation of Offenders (Jersey) Law 2001 is publicly available on the Jersey Legal Information Board website at the following address:

C

We have not found any recorded instances: see our response to question 'A' above.
