All planning applications, permits and letters relating to change of use or change of tenants for the following sites:

  • Barette Commercial Centre, La Route Du Mont Mado, St John
  • Springside Industrial Estate, La Rue De La Monnaie, Trinity
  • Thistlegrove Commercial Units, La Grande Route De St Laurent, St Lawrence.

Response

The information you have requested has been previously supplied to you in November 2014 under the Code of Practice on Public Access to Official Information.

Article 22 (1) (a) and (b) of the Freedom of Information (Jersey) Law 2011 states that a public authority need not comply with a request for information that has previously been complied with, where the applicant makes a request for information that is identical or substantially similar.

Article 22 (2) states that a scheduled public authority may refuse to comply with the request unless a reasonable interval has elapsed between compliance with the previous request and the making of the current request.

Your request will therefore not be processed further.

Refusal

Article 22 – A scheduled public authority need not comply with repeated requests

(1) This Article applies if:

(a) an applicant has previously made a request for information to a scheduled public authority that it has complied with; and

(b) the applicant makes a request for information that is identical or substantially similar.

(2) The scheduled public authority may refuse to comply with the request unless a reasonable interval has elapsed between compliance with the previous request and the making of the current request.

Justification:

  • repeated requests
  • public authority previously complied
  • information requested is substantially similar
  • information has not changed since previous request complied with and a reasonable interval has not elapsed since last request complied with
