Please can you provide me with the following information in respect of planning application p/2007/2789 and the case of [name redacted] v the Minister of Planning and the Environment [2008] JRC199:
A.
a copy of all correspondence in the possession of the Minister of Planning and the Environment from 2008 to present (whether held electronically, hard copy or archived)
B.
any accounts submitted to the Minister of Planning environment from 2008 to present.
C.
copies of all meeting notes, minutes, telephone notes in the possession of the Minister of the Planning and the Environment from 2008 to present.
Response
The Freedom of Information (Jersey) Law, 2011, gives rights of public access to information held by scheduled public authorities.
We have searched our paper and electronic records and copies of the paperwork you have requested have been prepared and are available for collection from the Department of the Environment, South Hill, St Helier.
Please ensure you quote the unique reference number (number redacted) when collecting the data. Opening hours are Monday to Friday 8.30am to 5pm daily. Customer parking is available on site.
Personal information has been redacted in accordance with Article 25(2) (a) and (b) of the Freedom of Information (Jersey) Law 2011.
Information relating to the provision of advice by the Bailiff, Deputy Bailiff, Attorney General or Solicitor General has been exempted in accordance with Article 31 of the Freedom of Information (Jersey) Law 2011.
Information supplied in confidence has been removed in accordance with Article 26 of the Freedom of Information (Jersey) Law 2011.
Exemptions
Article 25 Personal information
(2) Information is absolutely exempt information if:
(a) it constitutes personal data of which the applicant is not the data subject as defined in the Data Protection (Jersey)
Law 2005; and
(b) its supply to a member of the public would contravene any of the data protection principles, as defined in that Law.
Justification:
Absolute exemption: The documents contain personal data and, therefore identify individuals. This personal data has been removed.
Article 31 Advice by the Bailiff, Deputy Bailiff or a Law Officer
Information is qualified exempt information if it is or relates to the provision of advice by the Bailiff, Deputy Bailiff or the Attorney General or the Solicitor General.
Justification:
Qualified exemption: the file contains information relating to the provision of advice by the Bailiff, Deputy Bailiff or a Law Officer. This information has been removed.
Article 26 Information supplied in confidence
Information falls under this absolute exemption if:
a) it was obtained by the scheduled public authority from another person (including
another scheduled public authority)
b) disclosure of the information by the scheduled public authority would constitute an actionable breach of confidence.
Justification:
Absolute exemption: information held contains financial accounts supplied in confidence. This information has been removed.
