Please would you supply copies of Education Department emails, reports, analysis, correspondence and Ministerial Decisions relating to the Minister for Education's becoming a party to the Planning Obligation Agreement registered in the Public Registry of the Island on 8 November 2016, by order of the Court, between the following in relation to Field 790, L'Avenue de la Reine Elizabeth, St Peter:

  • the Chief Officer for the Environment

  • Field 790 Limited

  • Benjamin John Harvey

  • the Minister for Education

  • the Minister for Economic Development, Tourism, Sport and Culture

Response

The Minister for Education became a party to the Planning Obligation Agreement dated 8 November 2016 to acknowledge commitment for schools to use the facilities in accordance with the Service Level Agreement.

Much of the correspondence has passed retention, however we have been able to locate the attached documents within the time allowance of the Freedom of Information (Costs) (Jersey) Regulations 2014.

(1) Information is absolutely exempt information if it constitutes personal data of which the applicant is the data subject as defined in the Data Protection (Jersey) Law 2018.

(2) Information is absolutely exempt information if –

(a) it constitutes personal data of which the applicant is not the data subject as defined in the Data Protection (Jersey) Law 2018; and

(b) its supply to a member of the public would contravene any of the data protection principles, as defined in that Law.
