In accordance with commercial practice, no companies were required to or did tender for an exclusivity period within which to consider the Port Galots scheme. No contract has been awarded by the public which required a tender process.

The tender process was not completed by the States of Jersey but by the private sector company.
C.
Costs have been shared between the private sector company, and the public. The private sector company incurred all feasibility and concept scheme costs. To date, the public has incurred expenditure on the current scheme project development costs of £225,334.
Payments were made to the private sector company to reimburse pre-agreed costs incurred by them from suppliers, at cost. The agreement between the private sector company and these suppliers is a commercial agreement between third parties.
The private sector company has continued to incur costs in addition to those reimbursed to suppliers. In addition to the above payments, the project budget made the following internal direct payments in respect of the development scheme:
- planning fees (internal P&E): £32,802
- surveyors fees (internal TTS): £560
