Full pay scales for the prison staff are publicly available online. Article 23 of the Freedom of Information (Jersey) Law 2011 (information accessible by other means) has therefore been applied.

Exact staff numbers have not been disclosed for those roles where the number of employees is fewer than five. Therefore, we have been unable to provide the data as requested but for all roles however we have provided the data by pay groups to give information of the number of staff working in those pay groups, showing which job roles fall within each pay group.

Disclosure control has been applied to those where headcount is fewer than five to prevent identification of individuals. Article 25 (Personal Information) of the Freedom of Information (Jersey) Law 2011 has been applied.

The number of vacancies was extracted from the central system however when reviewed it was found to be inaccurate as it contained old posts and gave an inaccurate picture. To provide a response to this request would require manipulation of data. The Freedom of Information (Jersey) Law 2011 does not require a Scheduled Public Authority to manipulate data to provide a response. Therefore, this information is not held as per Article 3 of the Freedom of Information (Jersey) Law 2011.

Nothing has been spent on training, as the recruitment process is ongoing

As mentioned above, the recruitment process is still ongoing, therefore no prison officers have been recruited. Any new recruits will start their nine weeks training early January 2022.

Article 3 - Meaning of “information held by a public authority”
For the purposes of this Law, information is held by a public authority if –
(a) it is held by the authority, otherwise than on behalf of another person; or
(b) it is held by another person on behalf of the authority.
Article 23 - Information accessible to applicant by other means
(1) Information is absolutely exempt information if it is reasonably available to the applicant, otherwise than under this Law, whether or not free of charge.
(2) A scheduled public authority that refuses an application for information on this ground must make reasonable efforts to inform the applicant where the applicant may obtain the information.
Article 25 - Personal information
(1) Information is absolutely exempt information if it constitutes personal data of which the applicant is the data subject as defined in the Data Protection (Jersey) Law 2005.
(2) Information is absolutely exempt information if –
(a) it constitutes personal data of which the applicant is not the data subject as defined in the Data Protection (Jersey) Law 2018; and
(b) its supply to a member of the public would contravene any of the data protection principles, as defined in that Law.
