Request
I would like to know whether the Children's Commissioner (or any department) has given instruction to The States of Jersey Police in regard to how long a juvenile can be kept in custody for.
Response
As part of her role, the Children's Commissioner has previously exercised her legal authority to challenge certain decisions made by the States of Jersey Police. She has not provided "instruction", and decisions in regard to how long juveniles can be kept in police custody remain with the States of Jersey Police, and in accordance with Code C (Code of Practice for the detention, treatment and questioning of persons by Police Officers) of the Police Procedures and Criminal Evidence (Codes of Practice) (Jersey) Order 2004 which is available in the following link:
Police Procedures and Criminal Evidence (Codes of Practice) (Jersey) Order 2004 (jerseylaw.je)
The States of Jersey Police can also confirm that it has not received any instructions on how long juveniles can remain in police custody by any other government department or non-government organisation.
