Response
1 and 1a)
The Code of Conduct has been produced for all employees and provides guidance on how they should conduct themselves in their day to day work, and also sets out responsibilities regarding computer misuse.
The States of Jersey has an internal policy that is issued to all employees when they are given login access, and included in that policy under ‘Unacceptable Use’ is the following wording:
“Accessing, downloading, storing, processing, publishing, displaying or sending inappropriate material. For example, material that is illegal, pornographic, or likely to cause offense”.
In addition to the above, the States of Jersey also has a filtering system that filters out various categories of websites, pornography being one of them.
Therefore, it would not be possible for employees to access a categorised pornographic site while connected to the States of Jersey government network.

The States of Jersey disclosure log lists FOI requests received but does not differentiate obscure requests. The disclosure log can be found here:
FOI disclosure log
In accordance with Article 21 of the Freedom of Information (Jersey) Law 2011, a scheduled public authority can refuse a request which has the potential to cause a disproportionate level of disruption, irritation or distress in circumstances where the applicant has no real interest in the information and the information is being sought for an illegitimate reason, which may include a desire to cause administrative difficulty or inconvenience.
Indicators that a request is vexatious can be that the request is frivolous, whereby the request is inane or extremely trivial and the request seems to lack any serious purpose, including where the request is made for the sole purpose of amusement.
But it can also include frequent requests or requests that appear to be completely random in approach, that lack clear focus, or seem to be designed for the purpose of ‘fishing’ for information without any idea of what will be revealed.
Context and history in which a request is made will often be a major factor in determining whether a request is vexatious.
The value of any request which is of little benefit to the public will be restricted, even where there may be a serious purpose behind it.
The States of Jersey keeps an open mind about meeting its underlying commitment to transparency and openness and at times this will involve absorbing a certain level of disruption and annoyance.
However, this will be balanced against public resources being used on requests which are manifestly unjustified, inappropriate or an improper use of a formal procedure.
We would kindly ask that you bear this in mind for the future.
