I am requesting access to information on inappropriate material being accessed by government employees on government computers and Wi-Fi.

By inappropriate material this could mean gambling, pornography and any websites which are blocked or not deemed suitable for a professional workplace environment.

Over the last five years, how many government employees have been disciplined for attempting to access or accessing websites that are blocked or inappropriate at work?

Can you break down the number of employees which were disciplined by department?

How many government employees have been dismissed/ lost their job in the last five years for attempting to access or accessing websites that are blocked or inappropriate at work?

C

What was the job title of employees which were dismissed?

D

Prior to dismissal how many warnings did they have?

E

Which year, in the last five years had the most recorded disciplines and dismissal for accessing inappropriate content?

F

What was the most common discipline/dismissal for e.g., gambling, pornography?

G

Is it possible to have a breakdown of the last five years for dismissal and disciplines and  what they were for?

A and B

It is not possible to provide this data as requested. The case management system used by the Government of Jersey holds high-level data on case types but does not hold further details. It is not possible to share the detailed data requested without accessing individual case records within the system. It has been estimated that to collate the data requested would exceed the timescales prescribed by the Freedom of Information (Costs) (Jersey) Regulations 2014. Article 16 of the Freedom of Information (Jersey) Law 2011 has therefore been applied.

Article 3 - Meaning of “information held by a public authority”

For the purposes of this Law, information is held by a public authority if –

(a)     it is held by the authority, otherwise than on behalf of another person; or

(b)     it is held by another person on behalf of the authority.

Article 16 - A scheduled public authority may refuse to supply information if cost excessive

(1) A scheduled public authority that has been requested to supply information may refuse to supply the information if it estimates that the cost of doing so would exceed an amount determined in the manner prescribed by Regulations.
