Currently there have been no convictions under Article 38 of the Sexual Offences (Jersey) Law 2108 (Administering a substance to stupefy or overpower a person for sexual purposes).
The States of Jersey Police responds to all reports of spiking incidents. Upon receipt of a report, officers will carry out initial enquiries and investigations to establish the circumstances surrounding the allegation. The primary response is to safeguard the individual who is reporting a spiking incident.
The officers will then look to secure and preserve evidence by way of ensuring the relevant samples are taken. There are established pathways where the evidence can be secured, either at hospital, recovery by a Force Medical Examiner (FME) or by the way of an early evidence kit by the investigating officer.
The samples are then sent to the States Official Analyst for examination. In the last five years, the States of Jersey Police has not received any evidence from the States Official Analysts to confirm or support any spiking incident having occurred, therefore no convictions have taken place.
The States of Jersey Police along with key partners would like to remind members of the public to take precautionary measures whilst on licensed premises to minimise the risk of these types of incidents.
