I would like to request information regarding disciplinary proceedings against staff members in both private and public secondary schools in Jersey. Specifically, I am seeking details for the past [5] years on:

1. The total number of disciplinary proceedings attempted against staff members in secondary schools, including a breakdown by school (public and private).

2. The total number of disciplinary proceedings completed against staff members in secondary schools, including a breakdown by school (public and private).

3. A summary of the types of issues or infractions that led to these disciplinary proceedings (if available under FOI).

Please include any relevant information on attempted versus completed proceedings, including any distinctions between types of schools and the nature of disciplinary actions.

If any portion of this request is too broad or exceeds processing limits, please advise on how I can narrow it to facilitate compliance.

Response

1. Government of Jersey does hold information on disciplinary proceedings related to members of staff employed by Government of Jersey “provided” schools only, which includes the secondary provisions of Jersey College for Girls and Victoria College. The Government of Jersey does not hold data related to the island's private schools.  

Article 3 of the Freedom of Information (Jersey) Law 2011 has been applied.  

There were 12 disciplinary proceedings attempted in relation to staff members in secondary schools.

It is not possible to provide further breakdown as this could lead to the identification of individuals.  Article 25 of the Freedom of Information (Jersey) Law 2011 has been applied. 

2. There were 12 disciplinary proceedings attempted in relation to staff members in secondary schools.

3. The matters subject to proceedings were breachers of Government of Jersey Disciplinary Rules (including safeguarding), Codes of Practice, standards and values. 

It is not possible to provide further breakdown as this could lead to the identification of individuals.   Article 25 of the Freedom of Information (Jersey) Law 2011 has been applied.

Article 3 - Meaning of “information held by a public authority”

For the purposes of this Law, information is held by a public authority if –

(a)     it is held by the authority, otherwise than on behalf of another person; or

(b)     it is held by another person on behalf of the authority.

Article 25 - Personal information

(1) Information is absolutely exempt information if it constitutes personal data of which the applicant is the data subject as defined in the Data Protection (Jersey) Law 2018.​
