Please can I ask of Planning and Environment and Land Controls on behalf of a nearby local Cattle Farming business

Currently being Advertised for Sale by Maillards March 2025 at £30,000 a Vergee = 7 Vergees 36 perch of Prime Agricultural land in the Green Zone and currently these fields come under the policy of being Highly Protected Prime Agricultural land

Stables with Paddocks for sale

Field No 491 + Field 492 La Rue des Buttes, St Martin both Fields with 4 Timber built horse stables plus store rooms constructed in 2015 according to the JEP advert !

1. Please advise any Planning Conditions placed upon the use of or occupation of Fields 491 & 492?

2. If there are Planning or Land Control conditions attached, are they compliant to any new purchaser of these Fields?

3. Any Land control conditions upon these two fields? if so are these conditions Compliant when these Fields were purchased in 2015 or 2016?

Response

The information requested is exempt under Article 23 of the Freedom of Information (Jersey) Law 2011 as this information is accessible through the on-line planning register on www.gov.je.  The register can be accessed using the following link.

Searches relating to specified periods, e.g. month, can be carried out within the planning register and all applications are marked major or minor.  The register also allows you to view approved and pending cases.

Yes, the Land Controls conditions are compliant to any new purchaser of these fields.

3.

Yes, there are agricultural conditions placed upon both fields. These are: 

a) That fields 491, 492, St Martin shall not, without the consent of the Environment Minister, be occupied by anyone other than a bona fide inhabitant of the Island specifically approved by the Minister who is wholly or mainly engaged in work of an agricultural nature in Jersey for his own benefit and profit.  

b) That fields 491, 492, St Martin is used for agricultural or horticultural purposes only; this excludes the grazing of equine animals and the growing of trees without the written consent of the Environment Minister.  

c) That fields 491, 492, St Martin must not be occupied by the purchaser.  

d) The purchaser shall notify the Environment Minister of the leasing arrangements of fields 491, 492, St Martin by completing a land transaction form.

The owner was indeed using the fields in conjunction with the conditions as the field was being used for a commercial equine business, but these fields are no longer in use, they have not been used in conjunction with the conditions as they are for sale.    

The land and the stables on these fields will continue to have agricultural conditions attached on the next transaction.

Article 23 - Information accessible to applicant by other means

(1) Information is absolutely exempt information if it is reasonably available to the applicant, otherwise than under this Law, whether or not free of charge.

(2) A scheduled public authority that refuses an application for information on this ground must make reasonable efforts to inform the applicant where the applicant may obtain the information.​
