A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Install door, ramp and handrail to South-East elevation of existing entrance to form disabled access. REQUEST FOR RECONSIDERATION of refusal of planning permission.

 

Decision(s):

At the Planning Applications Panel meeting of 5/09/2012, the Panel were minded to approve the application against officer advice provided that the scheme was amended to retain the existing arch mouldings on the eastern elevation of the porch. As the decision was against officer advice, it was referred to the Minister on 10/09/2012 who requested to meet with the Reverend and Deputy of St Martin on site. A site visit was held on 25/10/2012 with officers present where various options were discussed. It was agreed that the best option was in the original location but with the retention of the existing arch moulding and a granite plinth to the ramp. The agent was instructed to submit revised drawings. Revised drawings were received on 13/03/2013.

 

However, the Request for Reconsideration pertains to the originally submitted plans. The Planning Applications Panel and the Minister for Planning and Environment have confirmed that they do not support the originally submitted plans with the removal of the existing arch mouldings. Therefore the Minister has decided to maintain the refused decision on the original scheme.

 

Reason(s) for Decision:

The originally submitted proposal, by reason of its design would adversely affect the architectural interest, the character of the listed building 'St Martin's Methodist Church' and its setting. It is therefore contrary to Policies GD1, GD7 and HE1 of the Island Plan 2011.
