Appointment of members to the Jersey Council for Safety and Health at Work

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

The Minister decided to appoint Mike Osborne, Paul Richardson, Clive Russell and Mike Baudains to serve as members of the Council for a three year term of office commencing 1st July 2008. The Minister also noted that Susan Ashford had been co-opted to serve on the Council.

Reason(s) for Decision:

The report and proposition on the Council, P 102, which was agreed by the States in 1991, provided for the Social Security Committee to appoint the members of the Jersey Council for Safety and Health at Work.

Resource Implications:

Appointment of members to the Jersey Council for Safety and Health at Work  

1.  SUMMARY  

The constitution of the Jersey Council for Safety and Health at Work, which was agreed by the States on the 30th July 1991, provides for the appointment of members to the Council by the Social Security Committee.  With the introduction of Ministerial Government, the responsibility for appointment of members now rests with the Minister for Social Security. 

The Minister is, therefore, requested to appoint persons put forward by the Chairman of Council, Mr R Staddon, to serve a three year term of office as members of the Council.  

2. BACKGROUND  

2.1   The Jersey Council for Safety and Health at Work  

The Council is an independent body set up by the States, to promote the health and safety of workers and others affected by work activities.  The Council consists of a Chairman, appointed by the States on the proposition of the Minister, and four members appointed by the Minister. 

Mr Staddon, the present Chairman of Council, was appointed by the States in accordance with the Council’s constitution, for a three year term of office commencing the 1st July 2007.  

The Council receives an annual grant to carry out its work and is required to submit an annual report and audited accounts to the States.  

2.2 Proposed members  

In accordance with the Council’s constitution, Members are appointed for a three year term of office.  

Council have sought new members in accordance with the Jersey Appointments Commission Code of Practice for Appointments to Autonomous and Quasi-Autonomous Public Bodies and Tribunals; with requests for interested parties to serve as members being advertised in the Jersey Evening Post. 

As a result of this appointment process, Mr Staddon has put forward the names of four new prospective members and one current member for consideration by the Minister.  The names and positions of the proposed new members are:   

Susan Ashford, Human Resources Manager, Hotel L’Horizon & Spa;

Mike Osborne, Managing Director, Ronez Ltd.;

Paul Richardson, Managing Director, Amalgamated Facilities Management Ltd.;

Clive Russell, Station Manager Service Delivery, States of Jersey Fire and Rescue Service. 

The existing member of Council who has put his name forward to serve a further term of office is Mike Baudains, Port Engineer, States of Jersey Transport and Technical Services Department.

If the Minister agrees to the proposals made by Mr Staddon, there will be five members of Council.  In view of the Council’s constitution which provides for four members, the fifth member will be co-opted onto the Council.  Sue Ashford has agreed to serve on Council in this capacity. 

2.3 Financial and manpower implications  

Members of Council serve on an honorary basis and therefore these appointments have no implications for the financial or manpower resources of the States. 

3. RECOMMENDATION  

It is recommended that the Minister agrees to the proposal by Mr Staddon, Chairman of the Jersey Council for Safety and Health at Work, for the appointment of four new members; Sue Ashford (co-opted), Mike Osborne, Paul Richardson and Clive Russell and reappointment of an existing member, Mike Baudains, to serve for a three year term of office commencing 1st July 2008.
