Intention to remove 6 (Wack's Bar) Havre de Pas, St. Helier from the list of proposed Sites of Special Interest

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):

The Assistant Minister for Planning and Environment determined that her intention was to remove from the List of proposed Sites of Special Interest 6 (Wack’s Bar), Havre de Pas, St. Helier as a Site of Special Interest by reason its lack of significant historic or architectural interest.

Reason(s) for Decision:

The intention to remove 6 (Wack’s Bar), Havre de Pas, St. Helier as a proposed Site of Special Interest from the List is in accordance with the existing criteria for assessment and designation of historic buildings such that 6 (Wack’s Bar), Havre de Pas does not satisfy the criteria that requires greater selectivity for post-1920 buildings: specifically, it is not a preprentative exampe of a recognisable design or sylaistc movemern; it does not display innovative use of materials or structural techniques; it is not by a well-known architect or designer; and it is not an unusual building tupe or rare survivor.

Legal and Resource Implications:

Article 51(2)(b) of the Planning and Building (Jersey) Law 2002 enables the Minister to remove buildings from the List of Sites of Special Interest for those buildings and places that the Minister is satisfied have no public importance by reason of the special archaeological, architectural, artistic, historical, scientific or traditional interest that attaches to the building or place

This report has been prepared by Jersey Heritage as part of its responsibility under a Service Level Agreement to provide reports and recommendations to the Minister for Planning and Environment on the architectural, historical and archaeological significance of buildings and sites.

 

The assessment and recommendation are made in accordance with the existing criteria for assessment and designation of historic buildings. 6 Havre des Pas (Wack’s Bar, formerly Prince’s Hotel) is currently registered as a pSSI.

 

Relevant interests of the site

 

The frontage of the public house is designed in early 19th century style with a decorative canopied balcony, but the building is modern - constructed in the 1970s. Although the appearance of its principal elevation is in keeping with the character of Havre des Pas, the building does not comply with the criteria for the assessment and designation of historic buildings and should be removed from the register.   

 

Advice offered by MRLAG (and others if stated)

 

MRLAG discussed the building at its meeting on 27 October 2008. Members were unanimous that 6 Havre des Pas should be removed from the Register.

 

Jersey Heritage recommendation

 

6 Havre des Pas should be removed from the historic buildings register.

 

Justification relating to criteria

 

Removal from the register of 6 Havre des Pas is in accordance with the existing criteria for assessment and designation of historic buildings as it is not of significant historic or architectural interest.  

 

6 Havre des Pas does not satisfy the criteria that requires greater selectivity for post-1920 buildings: specifically, it is not a representative example of a recognisable design or stylistic movement; it does not display innovative use of materials or structural techniques; it is not by a well-known architect or designer; and it is not an unusual building type or a rare survivor.
