Road Traffic (St Helier) (Jersey) Order 1996 and Road Traffic (Disabled Persons) (Parking) (Jersey) Order Amendments.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):

To amend the Road Traffic (St Helier) (Jersey) Order 1996 and the Road Traffic (Disabled Persons) (Parking) (Jersey) Order 2005.

Reason(s) for decision:

  1. To make permanent, additional on-street parking spaces in the town area.
  2. To introduce a new residents parking scheme in the Richmond Road area.
  3. To make adjustments to the existing residents parking area.
  4. To remove the taxi rank in Beresford Street outside he Central Market and to make the taxi rank in Beresford Street outside La Cala a 24 hour rank.

Action required:

Advise the Publications Editor and the Greffier of the States that the Order has been made.

TRANSPORT AND TECHNICAL SERVICES

ROAD TRAFFIC (ST HELIER) (AMENDMENT No.20) (JERSEY) ORDER 2007 AND ROAD TRAFFIC (DISABLED PERSONS) (PARKING) (AMENDMENT No.5) (JERSEY) ORDER 2007.

Purpose of the Report

To amend the Road Traffic (St Helier) (Jersey) Order 1996, and the Road Traffic (Disabled Persons) (Parking) (Jersey) Order 2002.

Background

On the 27th October 2006 the Minister for Transport and Technical Services approved Departmental requests and requests from the Parish of St Helier to amend the above Orders.

Discussion

The Minister approved the following requests:-

Items that were previously subject to a temporary Order made under Article 68 of the Road Traffic (Jersey) Law 1956, for a period not exceeding one year, are now to be made permanent.

  1. 10 minute disc “shoppers loading” spaces in Beresford Street.
  1. 20 minute pay card parking spaces in Museum Street, Val Plaisant, La Motte

Street, Old St Johns Road, St James Street, and La Colomberie.

  1. 1 hour pay card parking spaces in Cannon Street, Patriotic Street, Kensington

Place, Hue Street, Great Union Road and Great Union Street

  1. Unloading Bays in Val Plaisant, Aquila Road, and Great Union Road.
  1. To make a section of Great Union Street subject to a one way restriction.
  1. To introduce a new taxi rank in Beresford Street.

The following additional requests submitted by the Parish for inclusion in the Amendments.

  1. The reduction of time limit of the current two disabled persons’ parking bays in the Parade, from 4 hours to 1 hour limit, and the addition of two further 4 hour disabled parking bays in the Parade.
  1. The installation of one additional disabled persons parking bay in Great Union Road.
  1. Moving the location of the disabled persons’ parking bay in Clarence Road to a more suitable location.
  1. Re-locate the motorcycle parking facility from its current position in Providence Street to two new locations in Charles Street and Phillips Street, and 1 hour pay card parking in place of the current motorcycle parking facility in Providence Street.
  1. Re-locate two disabled persons’ parking spaces in Columbus Street to Albert Street.

The following adjustments to the existing St Marks Road – Stopford Road residents parking scheme submitted by the Residents Parking Coordinator for the Parish of St. Helier.

  1. Visitor parking currently free in the evenings to be changed to pay card only.
  1. Provide business permits valid from 08.00 to 18.00 hours at a reduced fee of £150.
  1. Formalise the motorcycle parking in Stopford Road and introduce motorcycle parking in Chevalier road.
  1. Allow residents to park in the three doctors parking spaces in the zone between 18.00 and 08.00 hours.
  1. Re locate a sign in Oxford Road to convert a free space into residents parking.
  1. Convert the Janvrin Road unloading bay into residents parking.
  1. Change the Stopford Road unloading bay into a 20 minute unloading bay between 8am and midnight with the bay being available to residents outside of these hours.
  1. Provide two additional residents parking spaces in Apsley Road.
  1. Provide one additional residents parking space in St Marks Road.

The Minister also approved a new residents parking scheme in Richmond Road.

Recommendation

The Minister is recommended to approve the Amendment to be effective from the 15th January 2007.

Reason for Decision

  1. To make permanent, additional on-street parking spaces in the town area.
  2. To introduce a new residents parking scheme in the Richmond Road area.
  3. To make adjustments to the existing residents parking area.
  4. To replace the taxi rank in Beresford Street outside the Central Market with additional 10 minute disc “shoppers loading” spaces and to make the taxi rank in Beresford Street outside “La Cala” a 24 hour rank.

Action Required

The Minister to instruct his officers to process the Ministerial decision.
