Motor Vehicles (Driving Licences) (Amendment No. 13) (Jersey) Order 2014

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):  The Minister made the Motor Vehicles (Driving Licences) (Amendment No. 13) (Jersey) Order 2014 which amends certain matters relating to the prescribed form of driving licences, adds further jurisdictions with mutual exchange arrangements and adjusts category exchange entitlement for certain jurisdictions.

 

Reason(s) for Decision:  To incorporate changes to producing licences and jurisdictions with mutual exchange arrangements into the legislation.

 

Resource Implications:  Advertising Order covered in DVS revenue budget.  Changes to the driving licence system will be funded by the parishes who maintain the system and retain all income from issuing driving licences.

 

Action required:  To notify the Greffier of the States and the Law Draftsman that the Order has been made, forward the signed and sealed Order to the Publications Editor, States Greffe, and request the Greffier of the States to arrange for its notification to the States.

 

Head of Driver and Vehicle Standards to ask the parishes to ensure the processes for producing and granting driving licences are updated to incorporate the changes from the commencement date.

MOTOR VEHICLES (DRIVING LICENCES) (AMENDMENT NO. 13) (JERSEY)

 

ORDER 2014

 

 

Purpose of the Report

 

To consider the Motor Vehicles (Driving Licences) (Amendment No. 13) (Jersey) Order 2014 which will amend certain matters relating to the prescribed form of driving licences, add further jurisdictions with mutual exchange arrangements and adjust category exchange entitlement for certain jurisdictions. 

 

 

Background

 

In May 2014 the Minister approved proposed changes to the Motor Vehicles (Driving Licences) (Jersey) Order 2003 and asked the Head of Driver and Vehicle Standards to prepare drafting instructions to amend the Order accordingly under MD-T-2014-0050.

 

Instructions to amend the Order were provided to the Law Draftsman, and an amendment to the Order has been drafted for the Minister to sign and seal.

 

 

Discussion

 

The Assistant Law Draftsman has produced the Motor Vehicles (Driving Licences) (Amendment No. 13) (Jersey) Order 2014 which provides for the minor amendments required to Schedules in the Motor Vehicles (Driving Licences) (Jersey) Order 2003 to:-

 

  1. Accommodate the parishes changing to laser engraving photocard licences, which is now a mandatory security requirement of the “Community Model Driving Licence”;

 

  1. Harmonise the position of the serial number of the licence (driver number) with the “Community Model Driving Licence”;

 

  1. Add Croatia, Czech Republic and Romania to those jurisdictions that have agreed the mutual exchange of driving licences with Jersey;

 

  1. Incorporate minor amendments to the categories granted on Jersey licences in exchange for older style UK licences and Swiss licences;

 

 

  1. Provide for EU Community Model driving licences with category A2 (motorcycle without sidecar, with a cylinder capacity of at least 400 cc, and an engine power of at least 25 kW) shown on them, offered in exchange to be granted category A on Jersey driving licences. 

 

The commencement date for the amendment Order has been set to allow the practical changes to printing of licences and software support to be done over a weekend and production of the new style of licence can commence at opening of business on the commencement date.

 

 

Recommendation

 

The Minister is recommended to make the Motor Vehicles (Driving Licences) (Amendment No. 13) (Jersey) Order 2014 which will amend certain matters relating to granting driving licences.
