Amendments to the Road Traffic (St. Peter) (Jersey) Order 1992 regarding La Rue du Craslin and La Ruelle es Ruaux.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

ROAD TRAFFIC (ST PETER) (JERSEY) ORDER 1992 – AMENDMENT No 6

Purpose of the Report

To improve the traffic management on two parish roads in the Parish of St Peter.

Background

1. The Connétable of St Peter has written to the Department requesting the Minister for Transport and Technical Services to amend the Parish Traffic Order to prohibit vehicles exceeding 6 feet 6 inches in width from a section of La Rue du Craslin.

2. The Connétable has also requested the Minister to prohibit waiting on a section of La Ruelle es Ruaux, opposite Netherby Court, for a period not exceeding 12 hours in any 24 hours.

Discussion

1. The request with regard to La Rue du Craslin is considered necessary as it is a narrow, busy road, with a number of sharp bends. The Parish feels that the road is therefore unsuitable for large vehicles, which pose a danger and cause congestion to other road users and residents. Additional housing development due to take place on this road will further exacerbate the current situation. The Parish therefore considers that the continued use of this road by vehicles exceeding 6 feet 6 inches is undesirable.

However, the Parish does wish to allow large vehicles to continue to operate, to and from “Jersey Steel”, from La Route de Beaumont. The restriction is therefore proposed to commence from the entrance of Ruelle du Marais (which leads to Jersey Steel) east, to its junction with Les Grupieaux.

2. The request with regard to La Ruelle es Ruaux is considered necessary due to vehicles being parked on this section of road for prolonged periods of time.

The Minister is requested to approve the attached Draft Road Traffic (St Peter) (Amendment No. 6) (Jersey) Order 2006 with regard to the above items, to be included in the Road Traffic (St Peter) (Jersey) Order 1992

Recommendation

The Minister is requested to approve the Amendment, to be effective on the seventh day after it is made.
