Grouville churchyard - funding excavation analysis of skeletal and ceramic artefacts

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):

1.     The Minister resolved to provide public funding, to the value of £9,900 in respect of the post excavation analysis of skeletal and ceramic artefacts from Grouville Churchyard, subject to the availability of resources;

2.     The Minister resolved to refund the planning application fee of £171 in relation to P/2008/2070: Construct single storey extension to north-west elevation and extend basement at Grouville Parish Church.

Reason(s) for Decision:

1.     The Minister considers that the use of public funds is warranted to specifically enable the detailed and specialist post excavation analysis of the skeletal and ceramic artefacts found at Grouville Churchyard owing to their potential archaeological significance;

2.     The Minister is minded to refund the planning application fee in view of the extent of archaeological evaluation required to be undertaken in association with the development of this site.

Legal and Resource Implications:

Planning Policy Note 1 Archaeology and Planning (2008) states that ‘in particular cases where the developer is a non-profit making community body…the Minister may exercise discretion and seek to provide assistance to ensure an appropriate archaeological evaluation.’

Article 5 of the Planning and Building (Fees)(Jersey) Order enables the Minister to waive planning application fees.

The Planning and Environment Department does not presently have any budgetary provision in relation to the cost of this post excavation analysis.

Action required:

1.     Advise the applicant of the Minister’s decision;

2.     Instruct commencement of the post excavation analysis, subject to the availability of resources.
