Residential Tenancy (Deposit Scheme) (Jersey) Regulations 201-

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject: Draft Residential Tenancy (Deposit Scheme) (Jersey) Regulations 201-: Decision by the Minister for Housing to lodge ‘au Greffe’.

Decision(s): The Minister for Housing decided to lodge ‘au Greffe’ the draft Residential Tenancy (Deposit Scheme) (Jersey) Regulations 201- for debate by the States Assembly on 14th July 2014.

Reason(s) for Decision: The Residential Tenancy (Deposit Scheme) (Jersey) Regulations 201- establish the regulatory framework for a tenancy deposit scheme. They include statutory provisions to protect a tenant’s deposit money paid in relation to a residential tenancy agreement and establish an alternative dispute resolution service in cases where a dispute arises about the sum of deposit money to be repaid at the end of a tenancy.

 

The Minister for Housing has brought forward the draft Regulations in response to the in principle decision of the States Assembly in 2009 (P.130/2009) to establish, by regulation, a scheme for the protection of tenants’ rental deposits and resolving any disputes arising under it. Accordingly, the Minister has brought forward, under Article 24 of the Residential Tenancy (Jersey) Law 2011, draft Regulations for States consideration.

Resource Implications: The deposit scheme will be an arms-length body and self-financing at no additional cost to the States. The means of funding for the scheme are explained further in the written report. There are very minimal costs arising for the States associated with the draft Regulations, which relate to ongoing supervision of the tenancy deposit scheme. These are accounted for within existing resources.

Action required: The Greffier of the States is requested to arrange to lodge ‘au Greffe’ the draft Residential Tenancy (Deposit Scheme) (Jersey) Regulations 201- for debate by the States Assembly on 14th July 2014.
