Immigration (Fees) (Jersey) Order 2017: Amendment: Law drafting instructions

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

DECISION AND REASON FOR THE DECISION:

 

The Assistant Minister agreed to increase Jersey’s immigration fees from 1 June 2018 so as to align them with the UK and requested the Law Draftsman to prepare the necessary amendment to the Immigration (Fees) (Jersey) Order 2017, pursuant to sections 67A, 67B and 67C of the Immigration Act 2014 as extended by the Immigration (Jersey) Order 2016.

 

The Minister has previously obtained the approval of the Minister for Treasury & Resources to align immigration fees in Jersey with those in the UK on an ongoing basis.

 

RESOURCE IMPLICATIONS:

 

There are no manpower implications. The fees will be aligned to those set in the United Kingdom.

Immigration (Fees) (Jersey) Order 2017: Amendment: Law drafting instructions

 

Immigration Fees – Report for the Assistant Home Affairs Minister

Introduction

Under powers conferred by the fees provisions of the Immigration Act 2014 as extended by the Immigration (Jersey) Order 2016 the Minister made the Immigration (Fees) (Jersey) Order 2017 [R&O.53/2017 “the 2017 Order”] which came into force on 19 May 2017.

 

The current fees under the 2017 Order are as follows:

  • Application in relation to a person who is a work permit holder, or a person who is a dependant of a work permit holder. . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . .  .  £677
  • Application in relation to a person who is not a work permit holder, or a person who is not a dependant of a work permit holder. .  . . . . . . . . . . . . . . . . . . . . . . . . . . .  . £933

The 2017 Order needs to be amended in order to carry into effect the established policy of aligning the level of the relevant Jersey immigration fees with the level of the relevant United Kingdom immigration fees. 

 

For this purpose, the amendment of the 2017 Order requires to be effective from 1 June 2018.

Recommendation

The Assistant Minister is therefore recommended to direct the Customs and Immigration Service to prepare instructions to the Law Draftsman to draft an amendment to the 2017 Order to increase fees in Jersey with effect from 1 June 2018 for the following applications:

  • Application in relation to a person who is a work permit holder, or a person who is a dependant of a work permit holder. . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . .  .  £704

(No amendment is required as regards the exceptions to application fees listed in Article 4 of the 2017 Order.)

The Minister has previously obtained the approval of the Minister for Treasury & Resources (Ref: TR-2011-DD92) to align immigration fees in Jersey with those in the UK.
