Request to Transfer Beach Trading Licence, Site No4 and Site No5,

The Beach Trading Licence / Beach Concession terms and conditions, section 11, specifies: The Licensee shall not assign or transfer the rights granted to the Licensee which are personal to the Licensee, nor assign, sub-let or otherwise part with possession of the demised area or any part thereof nor transfer or release control of its affairs to any other organisation, body or person without the prior written consent of the Department.
Background
The current concessionaire has been the licence holder since April 2008. The concession itself has been operated in the same manner as it is today, whereby it has offered for hire deckchairs, sun loungers, windbreaks, umbrellas and beach tents.
The operation itself trades from the beach and comprises of the following concessionary areas,
Site No.4 – from the western boundary of La Dauphin to the western end of the promenade
Site No.5 – from the western end of the promenade to the pier

Following receipt of an email, dated 23 September 2014, in which the concessionaire confirmed their intention to transfer the licence to a third party
Recommendation
My recommendation is for you to approve the request and grant consent to the licence holders, Sunnyside Deckchairs, of Site No.4 and Site No.5, St Belade’s Bay, to transfer the licence to a third party of the licence holder’s choice. This is subject to the new concession holder being able to fulfil the terms and conditions that apply to the licence for this concession.
