A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

AMENDMENT TO ROAD TRAFFIC (ST. HELIER) (JERSEY) ORDER 1996 AND ROAD

 

TRAFFIC (DISABLED PERSONS) (PARKING) (JERSEY) ORDER 2002

 

 

Purpose of the Report

 

To amend the Road Traffic (St. Helier) (Jersey) Order 1996 and the Road Traffic (Disabled Persons Parking) (Jersey) Order 2002.

 

 

Background

 

There have been a number of Article 68 Notices which have introduced temporary changes to the Road Traffic (St. Helier) (Jersey) Order 1996 and the Road Traffic (Disabled Persons Parking) (Jersey) Order 2002 since the last Amendments which require to be formally Scheduled.

 

As well as the Article 68 Notice items there are additional changes which are included below.

 

The Road Traffic (St. Helier) (Jersey) Order 1996 and the Road Traffic (Disabled Persons Parking) (Jersey) Order 2002 are both administered by Infrastructure, Housing and Environment.

 

 

Discussion

 

St. Aubin’s Road:

 

Changes to the areas of prohibition of waiting and a change to the disabled parking bays previously approved as an Article 68 notice;

  • Amend the entry in Schedule 4 - Prohibition of Waiting which currently reads “South side (between the eastern boundary of “Watkins Villas” and the western boundary of “Ebbtide”)” to “South side (between the eastern boundary of “Watkins Villas” and a point 39 yards west of the junction with the First Tower Spur Road)”
  • Amend the entry in Schedule 4 - Prohibition of Waiting which currently reads “South side (between a point 8 yards east of the western boundary of First Tower Methodist Church and the western boundary of No. 2 Romney Place) to “South side (between a point 14 yards east of the western boundary of First Tower Methodist Church to a point 76 yards east of the eastern junction with the eastern arm of Seafield Avenue)”
  • Add to Schedule 4 – Prohibition of Waiting St. Aubin’s Road “South side (from a point 22 yards east of the eastern junction with the eastern arm of Seafield Avenue to a point 9 yards further west)”

  • Add to the existing entry in Schedule 8 Part 2 - Paying Parking Places - 1 hour limit “South side from a point 77 yards west of the junction with the First Tower Spur Road to a point 55 yards further west” – this area also has a restriction of no vehicles over 6’6” width
  • Remove the entries for St Aubin’s Road in Schedule 8 Part 2 – Paying Parking Places – 1 hour limit “South Side (between the eastern boundary of No. 2 Romney Place and a point 27 yards east of the western arm of Seafield Avenue)” and “South side (between the eastern boundary of No.2 Romney Place and the western arm of Seafield Avenue)”
  • Add to Schedule 8 Part 2 – Paying Parking Places – 1 hour limit St. Aubin’s Road “South side (from a point 29 yards east of the eastern junction with the western arm of Seafield Avenue to a point 10 yards further east)” – this area also has a restriction of no vehicles over 6’6” width

Changes to the Road Traffic (Disabled Persons Parking) (Jersey) Order 2002;

 

Amend the entry in Schedule 1 (St. Helier) which currently reads “South side (between a point 8 yards east of the western boundary of First Tower Methodist Church for a distance of 12 yards)” to “South side (between a point 14 yards east of the western boundary of First Tower Methodist Church for a distance of 12 yards)”.

 

Commercial Buildings:

 

Change to the area of prohibition of waiting previously approved as an Article 68 notice;

Add to Schedule 4 - Prohibition of Waiting against the existing entries for Commercial Buildings “East side (from a point 7 yards south of the tunnel 5 ½ yards north turning west for a distance of 7 yards then south for a distance of 17 ½ yards)”

 

In order to provide a disabled parking space following a request from a business situated at Commercial Buildings it is proposed to change part of one of the 1 hour Paycard spaces into a Disabled Badge Holder space with a maximum stay of 4 hours.

 

Remove the entry in the Road Traffic (St. Helier) (Jersey) Order 1996 Schedule 8 Part 2 – Paying Parking Places – 1 hour limit for Commercial Buildings “East Side (between a point 272 yards south of the Tunnel and a point 280 yards further south)”.

 

Add to the Road Traffic (Disabled Persons) (Parking) (Jersey) Order 2002 in Schedule 1 – Parking Places for Vehicles used by Disabled Persons “St. Helier Parking Places – 4 hour limit” after the entry for Clearview Street “Commercial Buildings (East side between a point 272 yards south of the Tunnel and a point 280 yards further south)”

 

La Route de la Liberation:

 

Add a new unloading bay on the southern side of the Jersey Finance Centre on the northern side of the east bound slip road off La Route de la Liberation previously approved as an Article 68 notice:

Add to Schedule 10 Part 1 a new entry for La Route de la Liberation (eastbound slip road to the junction with Castle Street overpass) “North side (57 yards west from the junction with Castle Street to a point 21 yards further west)” in the first and second columns, “20 minutes” in the third column and “5 a.m. to 6 p.m. Monday to Saturday” in the fourth column.

Drury Lane:

 

Change to the area of prohibition of waiting and Parking Discs – 3 hours previously introduced as an Article 68 notice by the Parish of St Helier;

Add a new entry in Schedule 4 - Prohibition of Waiting for Drury Lane “East side (from the junction with Dongola Road to the junction with Rouge Bouillon)”, “West side (from the junction with Dongola Road to the northern boundary of “Inglis House”) and “West side (from a point 22 yards south of the northern boundary of “Inlgis House” to the junction with Rouge Bouillon);

Add a new entry in Schedule 8 Part 6 for Drury Lane “East side (between the northern boundary of “Inglis House” and a point 22 yards south).

 

Mount Bingham:

 

Change to the area of Parking Discs – 3 hours and to Parking places restricted to vehicles not exceeding 6 feet 6 inches in width and to a time limit of 12 hours previously introduced as an Article 68 notice by the Parish of St Helier;

Add a new entry in Schedule 8 Part 6 for Mount Bingham (Link road to the Territorial Army Centre (south western arm) “Southeast side”;

Remove the existing entry in Schedule 8 Part 13 for Mount Bingham (Link road to the Territorial Army Centre (south western arm) “Southeast side”.

 

Richmond Road:

 

Change to the area of prohibition of waiting, to the area for Parking discs – 3 hours and to the Zone parking places reserved for permit holders previously introduced as an Article 68 notice by the Parish of St Helier;

Amend the existing entries in Schedule 4 - Prohibition of Waiting in respect of Richmond Road as follows:

Replace the existing entry “South and east sides (between the northern entrance to Le Clos de Debonnaire and a point 22 yards west and south)” with “South and east sides (between the northern entrance to Le Clos de Debonnaire and a point 99 yards west and south)”;

Amend the existing entry in Schedule 8 Part 6 in respect of Richmond Road as follows: replace the existing entry “East side (between a point 22 yards west and south of the northern entrance to Le Clos de Debonnaire and a point 17 yards south of the southern boundary of the property “Rose Cottage”) with “East side (between a point 1 yard north of the southern boundary of No. 55 La Grande Pouclee and a point 19 yards south of the southern boundary of the property “Rose Cottage”);

Amend the existing entry in Schedule 9 Part 2 – Zone Parking Places in respect of Richmond Road as follows: replace the existing entry “West side (from its junction with the entrance to Le Clos de Debonnaire to a point 2 yards north of th southern boundary of the property “Rose Cottage”) with “West side (from its junction with the entrance to Le Clos Debonnaire to a point 2 yards north of the southern boundary of the property “1 Richmond Villas”).

 

La Motte Street:

 

Change to the Road Traffic (Disabled Persons Parking) (Jersey) Order 2002 to the maximum waiting period allowed in the disabled parking area from the current 4 hours to 2 hours outside Philip Le Feuvre House to increase the turnover of these spaces thus making them more available to disabled persons wishing to park to visit the Customer and Local Services building:

  • Remove the entry in Schedule 1 St. Helier Parking places – 4 hour for La Motte Street “North side (between a point 6 yards east of the western boundary of No. 39 and a point 11 yards westwards)” and add in Schedule 1 St. Helier Parking places – 2 hour La Motte Street “North side (between a point 6 yards east of the western boundary of No. 39 and a point 11 yards westwards)”.

Esplanade:

 

Change 2 areas of paycard parking to parking for vehicles displaying a valid Car Club Permit previously introduced as an Article 68 notice:

  • Remove the entry in Schedule 8 Part 2 - Paying Parking Places - 1 hour limit – Paying Parking Places 1 hour limit for Esplanade “North side (between a point 99 yards east of its junction with Castle Street and a point 13 yards further east) and the entry for Esplanade “North side (between a point 23 yards east of the eastern boundary of “Marina Court” and a point 12 yards further east);
  • Add new entries in Schedule 8 Part 15 – Car Club Permit Parking for Esplanade “North side (between a point 99 yards east of its junction with Castle Street and a point 13 yards further east) and “North side (between a point 23 yards east of the eastern boundary of “Marina Court” and a point 12 yards further east)

 

La Colomberie:

 

Increase the existing 20 minute pay parking area by 4 yards to provide a further pay parking space in an area which is routinely abused and to schedule the existing prohibition line on the south side:

  • Change the existing entry in Schedule 8 Part 1 – Paying parking Places 20 minute limit  for Colomberie from “South side (between a point 10 yards east of Roseville Street and a point 24 yards further east)” to “South side (between a point 10 yards east of Roseville Street and a point 28 yards further east)”
  • Add to the existing entry in Schedule 4 - Prohibition of Waiting – Prohibition of Waiting “South side from the junction with St Clements Road to a point 38 yards west of the junction with Roseville Street”

 

Roseville Street:

 

To change the existing 1 hour pay parking spaces on the north of the road to 20 minute pay parking spaces. This will increase the turnover and help those visiting the shops and businesses along La Colomberie:

  • Remove the existing entry for Roseville Street from Schedule 8 Part 2 - Paying Parking Places - 1 hour limit – Paying Parking Places 1 hour limit “East side (between Hastings Road and a point 20 yards south of Colomberie)”;
  • Add to Schedule 8 Part 1 – Paying Parking Places 20 minute limit Roseville Street “East side (from a point 16.5 yards from the junction with Colomberie to a point 15.5 yards further south)”;
  • Add to Schedule 8 Part 1 – Paying Parking Places 20 minute limit Roseville Street “East side (from a point 46 yards from the junction with Colomberie to a point 19 yards further south)”;
  • Amend the entry in Schedule 4 - Prohibition of Waiting – Prohibition of Waiting from “East side (between Colomberie and a point 20 yards south)” to “East side (between the junction with Colomberie and a point 16.5 yards south)”
  • Add to Schedule 4 - Prohibition of Waiting – Prohibition of Waiting “Roseville Street – East side (from a point 32 yards from the junction with Colomberie to a point 14 yards further south)”;
  • Add to Schedule 4 - Prohibition of Waiting – Prohibition of Waiting “Roseville Street – East side (from a point 65 yards from the junction with Colomberie to a point 27 yards further south)”

To add new 1 hour pay parking spaces outside the new Metropole housing development. The sections of highway concerned are already designated by surface treatment as being for parking. There will be some bike racks and bollards to help protect the turning movements into some of the domestic accesses on the west side of the road and the Department will need to arrange for the planter’s position to be adjusted to accommodate these measures better. Restricted parking will remain in the visibility splay of the developments underground parking garage. 1 hour pay parking will be permitted in the area indicated in appendix 10 Fig 8. Maintenance requirements can arrange for the parking bay to be suspended by Parking Control as is the case across the remainder of town.

  • Add to Schedule 8 Part 2 - Paying Parking Places - 1 hour limit – Paying Parking Places 1 hour limit “Roseville Street – East Side (from a point 92 yards from the junction with Colomberie to a point 18.5 yards further south)
  • Add to Schedule 8 Part 2 - Paying Parking Places - 1 hour limit – Paying Parking Places 1 hour limit “Roseville Street – East Side (from a point 115 yards from the junction with Colomberie to a point 22 yards further south)
  • Add to Schedule 8 Part 2 - Paying Parking Places - 1 hour limit – Paying Parking Places 1 hour limit “Roseville Street – East Side (from a point 169 yards from the junction with Colomberie to a point 7.5 yards further south)

 

Hastings Road:

 

In line with Department policy to remove Disc parking on States main roads and to replace it with pay parking spaces, the existing Disc parking bay on Hastings Road is to be converted and extended by 13 yards to be in line with street light H929. This will accommodate extra parking and will formalise the illegal parking that takes place there now.

  • Remove the entry for Hastings Road “North side (between a point 26 yards east of its junction with Roseville Street and a point 35 yards further east)” from Schedule 8 Part 4;
  • Add to Schedule 8 Part 3 after the entry for Great Union Road – Hastings Road “North side (between a point 13 yards east of its junction with Roseville Street and a point 50 yards further east)”
  • Replace the entry in Schedule 4 - Prohibition of Waiting – Prohibition of Waiting for Hastings Road “North Side (between Roseville Street and a point 26 yards east)” with Hastings Road “North Side (between the junction with Roseville Street and a point 13 yards east)”

 

Green Street:

 

To formalise the changes made as part of the recent road improvements to Green Street traffic flow.

  • Add to Schedule 1 Part 1 – One Way Traffic Routes “Green Street (from a point 80 yards south of La Route du Fort, to a point 70 yards south of La Route du Fort)”;
  • Remove the entry in Schedule 1 Part 2 – One Way Traffic Routes for Vehicles Exceeding 6 Feet 6 Inches in Width for Green Street;
  • Add to Schedule 1 Part 3 – Exemptions “Green Street (Pedal Cycles and Omnibuses)”.

 

Resident’s Parking Permits – Fees

 

The Parish of St Helier have requested an increase to the fees charged for the various Resident’s Parking Permits be included in the Amendment as below:

 

  • Amend the entry in Article 32 (1) (a) (i) from the current £293 to £326.81;
  • Amend the entry in Article 32 (1) (a) (ii) from the current £146 to £162.37;
  • Amend the entry in Article 32 (1) (b) from the current £219 to £242.80.

 

Conway Street

 

Changes made to Conway Street to widen the pavements resulted in the loss of the previous 1 hour Paid Parking area which was removed, this has never been formally removed from the Road Traffic (St. Helier) (Jersey) Order 1996. In order to bring this up to date the following changes are required:

 

  • Remove the entry in Schedule 8 Part 2 – Paying Parking Places – 1 Hour Limit for “Conway Street East side (between a point 10 yards north of the southern boundary of the Pomme D’Or Hotel and a point 39 yards further north)”;
  • Add to Schedule 4 – Prohibition of Waiting “Conway Street (east side).

 

 

Conclusion

 

A number of changes have been effected using Article 68 Notices, a further number of changes and additions to the Order in various locations which now require formal Scheduling.

 

 

Recommendations

 

The Minister for Infrastructure is recommended to instruct Officers to issue Law Drafting instructions to amend the Road Traffic (St. Helier) (Jersey) Order 1996 and the Road Traffic (Disabled Persons Parking) (Jersey) Order 2002.
