Request to increase the Prison establishment by two 0.25 posts.

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Decision(s):

To approve the request to increase the establishment of the prison by two 0.25 posts to allow the appointment of a Chaplaincy Team.

Reason(s) for decision:

A part time Chaplain has been appointed supported by two Ministers (one a Catholic and the other a Methodist) who work for approximately 10 hours each per week. In order to regularise their position and offer them the same terms and conditions as the part time Chaplain it is necessary to increase the prison’s establishment to cover the two posts.

Action required:

Steven Guy-Gibbens, Prison Governor, to arrange for this decision to be communicated to the Minister for Treasury and Resources.

REQUEST TO INCREASE THE PRISON ESTABLISHMENT BY TWO 0.25 POSTS (CHAPLAIN)

1. The Purpose of the Report

1.1 The report seeks the Minister’s approval to request the increase in the establishment of the prison by two 0.25 posts to allow the appointment of a two part-time Chaplains.

2. The Issue

2.1 The Minister approved the request to increase the prison establishment to permit the appointment of a part-time Chaplain in February 2006.

2.2 The Treasury and Resources Minister declined the request stating that vacancies elsewhere in Home Affairs should be used to fill the post in the first instance.

2.3 A part time Chaplain has been appointed supported by two Ministers (one a Catholic and the other a Methodist) who work for approximately 10 hours each per week. In order to regularise their position and offer them the same terms and conditions as the part time Chaplain it is necessary to increase the prison’s establishment to cover the two posts.

2.4 The Dean of Jersey is very keen for this approach to be successful and is content to be brought into discussions if necessary.

2.5 This proposal would have very little budgetary impact as the staff involved are already receiving remuneration for their tasks.

3. Recommendation

3.1 The proposal is that permission is sought to obtain two additional 0.25 posts for the prison to enable the appointment of the Chaplaincy team.

3.2 The Minister is asked to agree that this recommendation can be forwarded to the Minister for Treasury and Resources.
