States Social Housing Rental Charges: 2.15% Increase with effect from 7 October 2013

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject: Increase in social housing rental charges with effect from 7th October 2013.

Decision(s):

The Minister

  1. Approved the increase in Social Housing rental charges by 2.15% with effect from 7th October 2013.
  2. Requested the Minister for Treasury & Resources to agree an adjustment to the Department’s cash limit of £148,700, £600,200 and £622,300 in 2013, 2014 and 2015 respectively.

Reason(s) for Decision:

  1. P33/2013 – The Reform of Social Housing which was approved by the States Assembly on 16th May 2013 proposes that rents be increased at a rate of RPI + 0.75% on an annual basis. RPI at March 2013 was 1.4%. An additional 0.75% brings the percentage increase to 2.15%.
  2. The increase is lower than expected in the MTFP 2013-2015 and will have an impact on the income for the Department in 2013, 2014 and 2015. The shortfall in income from that forecast in the MTFP is £148,700, £600,200 and £622,300 in 2013, 2014 and 2015 respectively.  In addition the omission of this adjustment will leave a shortfall of income in the assumptions of R15/2013 – States of Jersey Housing Transformation Programme: Full Business Case.

Resource Implications:

Financial: An increase in income of £219,200 in 2013 and £876,800 in 2014.

Action required: Finance Director to implement the increase and agree an adjustment to the Department’s cash limits in 2013, 2014 and 2015 with the Minister for Treasury & Resources.
