Road Traffic (St. Saviour) (Jersey) Order 2000 : Amendment: Law Drafting instructions

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

INFRASTRUCTURE, HOUSING AND ENVIRONMENT

 

ROAD TRAFFIC (ST. SAVIOUR) (JERSEY) ORDER 2000 - AMENDMENT

 

 

Purpose of the Report

 

To amend the Road Traffic (St. Saviour) (Jersey) Order 2000.

 

 

Background

 

The Road Traffic (St. Saviour) (Jersey) Order 2000 currently contains a contradiction with traffic allowed to use Les Varines.

 

To add a one-way traffic flow in Bagatelle Lane to Schedule 1 Part 1.

 

 

Discussion

 

The inclusion of Les Varines in Schedule 1 Part 3 is incorrect as the road is not to be used by a vehicle exceeding 6 feet 6 inches in width in either direction. To correct this the listing of Les Varines in Schedule 1 Part 3 should be removed.

 

On 26 July 2019 the Minister for Infrastructure approved a scheme to provide pedestrian safety improvements on Bagatelle Lane which have now been completed and this included the introduction of a one-way traffic flow for north bound traffic which requires to be scheduled. In Schedule 1 Part 1 after the entry for Albert Road, add Bagatelle Lane in column 1 and Bagatelle Road to Wellington Road in column 2.

 

There is also a requirement for the entire length of Bagatelle Lane to be scheduled as a Prohibition of Waiting in line with the pedestrian safety improvements previously approved by the Minister. To amend the current entry for Bagatelle Lane in Schedule 3 Part 1 to: both sides from the junction with Bagatelle Road to the junction with Wellington Road.

 

 

Conclusion

 

Removal of the listing of Les Varines in Schedule 1 Part 3 will correct the current error and listing Bagatelle Lane in Schedule 1 Part 1 and Schedule 3 Part 1 will formalise the one-way traffic flow for northbound traffic and the Prohibition of Waiting as previously approved in the improvements to pedestrian safety proposal.

 

 

Recommendations

 

The Minister is recommended to instruct Officers to issue Law Drafting instructions to amend the Road Traffic (St. Saviour) (Jersey) Order 2000.
