TRAFFIC (DISABLED PERSONS) (PARKING) (JERSEY) ORDER 2002
Purpose of the Report
To amend the Road Traffic (St Helier) (Jersey) Order 1996, and the Road Traffic (Disabled Persons) (Parking) (Jersey) Order 2002
Background
Between 01 December 2008 and 01 March 2010, fourteen Temporary Orders were made by this Department, and the Connétable of St Helier, following consultation with the Minister for Transport and Technical Services under Article 68 of the Road Traffic (Jersey) Law 1956, for a period not exceeding twelve months. These Temporary Orders were required to be implemented without the delay involved in the normal law drafting process, and with the intention of including them in the Road Traffic (St Helier) (Jersey) Order 1996, and the Road Traffic (Disabled Persons) (Parking) (Jersey) Order 2002 at a later date.
A Temporary Order was also made on 18 December 2009 under Article 68 of the Road Traffic (Jersey) Law 1956, and under delegated powers within Transport and Technical Services Department to make the taxi rank at the eastern end of Beresford Street subject to 20 minutes pay-card parking from 8am – 5pm Monday to Saturday, and revert back to a taxi rank at other times.
Additional Requests
The Parish request changes to the parking arrangements in Seale Street in order to widen the northern footway.
The Parish also request minor changes to the parking arrangements in Halkett Place, near the Central Library, as part of the Town Urban Renewal Program.
Discussion
Temporary Orders
The Temporary Orders made under Article 68 of the Road Traffic (Jersey) Law 1956 are as follows:-
1. Commercial Buildings. 01 December 2008. To install an unloading bay on the eastern side. (Plan No.1)
2. Old Mont Cochon. (Parish Notice) 11 March 2009. To make a section of the hill subject to a one way restriction in a northerly direction. (Plan No.2)
3. La Motte Street. 27 April 2009. Changes to parking restrictions as part of the Town Urban Renewal program. Removal of all 1 hour pay-card parking.
4. La Route de St Aubin, east of the exit from Seafield Avenue. 26 May 2009. The removal of two 1 hour pay-card parking spaces, to improve visibility when exiting Seafield Avenue. (Plan No.3)
5. Union Street. 01 June 2009. To change the times of loading, and unloading in the two unloading bays between Dumaresq Street and New Street from 5.00am – 6.00pm to 5.00am - midnight .
6. Disabled Persons Parking. 10 June 2009. To prohibit disabled motorists from returning to a disabled persons parking bay within one hour of leaving that bay.
7. Cheapside. 19 June 2009. Changes to parking restrictions to facilitate al fresco eating at “La Cantina” Restaurant. (Plan No.4)
8. Journeaux Street. (Parish Notice) 22 June 2009. To change the minibus parking bay formerly used by the “Good Companions Club” to 1 hour pay-card parking.
9. Patriotic Street / Newgate Street. (Parish Notice) 17 August 2009. Changes to existing parking arrangements to allow doctors parking spaces. (Plan No.5)
10. Esplanade. 26 August 2009. To change the bus stop outside of “Sir Walter Raleigh House” to an unloading bay. (Plan No.6)
11. Rue de Trachy. (Parish Notice) 21 September 2009. To remove one 3 hour disc parking space to allow a resident improved access to her property. (Plan No.7)
12. Roseville Street. (Parish Notice) 21 September 2009. To introduce one, one hour limit, disabled persons parking space. (Plan No.8)
13. Hilgrove Street. 07 December 2009. To close Hilgrove Street to all vehicular traffic from Halkett Place to 35 Hilgrove Street, between 10am and 6am the following day.
14. Pomona Road. (Parish Notice) 01 March 2010. To introduce two additional on street parking spaces, one for residents’ only, and one for two hour pay-card parking from 09.00 hours to 22.00 hours, and reverting to residents’ parking at all other times (Plan No.9)
The Temporary Order made under delegated powers within the Transport and Technical Services Department with regard to Beresford Street, was made following requests from the public for additional short term parking in the area. With the agreement of the taxi drivers, the taxi rank at the eastern end of Beresford Street was made subject to 20 minutes pay-card parking from 8am – 5pm, Monday to Saturday, and reverts back to a taxi rank at other times. The Temporary Order was implemented on 18 December 2009, with a view to making the change permanent.
Additional Requests
Due to recent footpath widening on a section of Seale Street, it has been necessary for the Parish to remove the previous parking arrangements in the road, and have requested that it be made subject to a 6 feet 6 inches width restriction. The Parish also wish to provide one unloading bay with a 20 minute time limit, and a 16 yards section of special parking for vehicles used in connection with business at the Town Hall. This parking space would only be available in connection with a business visit or delivery to the Town Hall, and permission would have to be granted in writing by the Connétable, and placed on view in the windscreen of the vehicle. With regard to Halkett Place, the Parish have requested that the 1 hour pay-card parking and the 1 hour disabled persons parking on the west side, near the Central Library, be moved to accommodate the recently completed build out of the footpath at this location. (Plan No.11)
Parking at Commercial Buildings
The Assistant Manager – Parking Control has been made aware of a possible anomaly in the St Helier Order that may allow a motorist to move from a pay-card parking space directly to a disc parking space at Commercial Buildings, within one hour, without having committed an offence, but if that motorist moved directly from a parking disc space to a pay-card parking space an offence would have been committed.
The Law Draftsman will be requested to clarify if this is the case, and if so to amend the relevant article, in the Order, so that it would also be an offence to move from a pay-card parking space to a parking disc space within one hour.
Recommendation
The Minister is recommended to approve the above requests.
Reason (s) for Decision
To make permanent the fourteen Temporary Orders made under Article 68 of the Road Traffic (Jersey) Law 1956, and include them in the Road Traffic (St Helier) (Jersey) Order 1996, and the Road Traffic (Disabled Persons) (Parking) (Jersey) Order 2005.
To make Seale Street subject to a 6 feet 6 inches width restriction, and provide one parking bay for loading and unloading, and a 16 yard section of special permit parking.
To make minor changes to the current parking arrangements in Halkett Place near the Central Library
To make permanent the 20 minute pay-card parking (8am – 5pm) at the taxi rank in Beresford Street.
Action Required
Officers to instruct the Law Draftsman to prepare an Amendment to the Orders for subsequent submission to the Minister.
