Transfer of Funding: Howard Davis Farm Animal Incinerator Works

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject:  Transfer of funding of £145,000 from Jersey Property Holdings (JPH) to Transport and Technical Services (TTS) re Howard Davis Farm Animal Incinerator Works

 

Decision(s):  The Minister approved a capital budget transfer of £145,000 from JPH to TTS to enhance the Animal Carcass Incinerator at Howard Davis Farm.

 

Reason(s) for Decision:   The enhancement of the Animal Carcass Incinerator forms part of a wider scheme of works at the site at Howard Davis Farm occupied by Acorn Enterprises and TTS. The enhancement can be undertaken as a stand alone element and is best managed by TTS who will operate the enhanced facility.

 

Resource Implications:  None

 

Action required:  In accordance with Financial Direction 3.6 (paragraph 5.9) TTS are required to seek the approval of the Minister for Treasury and Resources before the Treasury Department can action the capital budget transfer of £145,000 from JPH to TTS.

HDF Animal Carcass Incinerator – Capital budget transfer

 

 

Purpose of Report

The Minister is asked to approve the transfer of £145,000 from JPH to TTS to undertake the enhancement works on the Howard Davis Farm animal carcass incinerator.

 

 

Discussion

Relocation of the Animal Carcass Incinerator is required to comply with the terms of the proposed covenant variation at Howard Davis Farm. In the last year an opportunity has arisen to separate the incinerator from the adjacent Acorn Enterprise site and relocate the pet cremator, which is required to facilitate the relocation of the dairy.

 

The project comprises four elements:

 

1. Provide a capitalised ground rent to the Howard Davis Farm Trust

 

2. Undertake works to existing animal carcass incinerator to make  permanent

 

3. Incorporation of the pet cremator with the animal carcass incinerator

 

4. Undertake works to separate the sites and upgrade of Acorn Enterprise               property

 

The overall project budget was allocated to JPH to control and manage the project. However, it is now considered that the enhancement of the animal carcass incinerator can be undertaken as a stand alone element of the project and is best managed by TTS, on whose balance sheet the equipment sits and who will operate the enhanced facility.

 

 

Recommendation

That the Minister approve a budget transfer of £145,000 from JPH to TTS.
