Records Advisory Panel: Appointment of Members

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

  1. Introduction

This report conveys the conclusions of the appointments panel established to recommend prospective members of the Records Advisory Panel to the Minister for appointment, the terms of office of the current panel expiring this month.

  1. Background

The Records Advisory Panel is established under Article 14(2) of the Public Records (Jersey) Law 2002 to review the functioning of bodies under the Law and to advise the Minister, Jersey Heritage, public institutions and the Archivist, as required.  There are five members who sit for a renewable term of six years, normally meeting three or four times a year.

Jersey Heritage has advertised for panel members, the terms of office of the current panel expiring on 11 December.  Two members of the existing panel re-applied to serve for a further term, while applications were received from three prospective new members.

All five were interviewed by a panel chaired by a member of the Jersey Heritage Board, Advocate Claire Follain-Metcalfe and also including retiring panel member Mr Henry Coutanche and the DfESC’s Cultural Development Officer.  The panel recommends that all five applicants are appointed by the Minister pursuant to the Law.  The members are:

Mrs M-L. Backhurst

Miss M.M Billot (existing member)

Mrs A.H. Harris

Mr J.M.E. Harris

Mr M.C. Sunier (existing member)

The interview panel further recommended that the Minister appoint Mr J.M.E. Harris as Panel chairman under article 14(4) of the Law.

  1.    Next steps

Once the appointments are confirmed, panel members will take their oath of office before the Royal Court before formally serving on the panel.  Under Article 14(5) of the Law the States is to be formally notified of the appointments and a States Report will be sent to the States Greffe accordingly.

  1.    Recommendation

The Minister is recommended to confirm the appointments to the Records Advisory Panel in order that the new panel can be formally convened for its first meeting in 2016.
