Comprehensive Spending Review: Allocation of Restructuring Provision and Budget Transfers

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject:   Approval of requests for Restructuring Provision funds in support of the Comprehensive Spending Review programme and transfer of budgets to the Chief Minister’s, Economic Development and Home Affairs Departments.

Decision(s):  The Minister approved:

(a)   four requests totalling £492,600, the funding for which was agreed by the Council of Ministers on 20 September 2012, in support of the Comprehensive Spending Review to be funded from the Restructuring Provision; and

(b)   budget transfers of £387,600 and £105,000 in 2012 and 2013 respectively from the Restructuring Provision to the Chief Minister’s, Economic Development and Home Affairs Departments, under Article 2(6) of the Public Finances (Transitional Arrangements) (Jersey) Order 2011.

Reason(s) for Decision:  

The States recognised the need to invest funds to achieve savings when it approved a Restructuring Provision in the 2011 and 2012 budgets and the Council of Ministers acknowledges that further investment will be needed to ensure Public Sector Reform is successful. The draft MTFP has earmarked funds to provide for this funding over the next three years.

 

Article 15(1)(a) of the Public Finances (Jersey) Law 2005 states that all or any part of the amount appropriated by a head of expenditure may, with the approval of the Minister for Treasury and Resources, be used for the purposes of another head of expenditure.

Resource Implications:  

The Restructuring Provision to decrease by £387,600 and £105,000 in 2012 and 2013 respectively and:

(a)   the Chief Minister’s Department’s revenue head of expenditure to increase by £161,100 and £105,000 in 2012 and 2013 respectively;

(b)   the Economic Development Department’s revenue head of expenditure to increase by £156,500 in 2012; and

(c)    the Home Affairs Department’s revenue head of expenditure to increase by £70,000 in 2012. 

 

This decision does not change the total amount of expenditure approved by the States for 2012.

 

Following approval of this decision, £4.1 million will remain in the Restructuring Provision at the end of 2013.

Action required:  

Head of Financial Management, Accounting and Reporting to notify the Comprehensive Spending Review Programme Director that this decision has been approved.
