Road Traffic (Public Parking Places) (Jersey) Order 2006: Proposed Amendment

A formal published “Ministerial Decision” is required as a record of the decision of a Minister (or an Assistant Minister where they have delegated authority) as they exercise their responsibilities and powers.

Ministers are elected by the States Assembly and have legal responsibilities and powers as “corporation sole” under the States of Jersey Law 2005 by virtue of their office and in their areas of responsibility, including entering into agreements, and under any legislation conferring on them powers.

An accurate record of “Ministerial Decisions” is vital to effective governance, including:

  • demonstrating that good governance, and clear lines of accountability and authority, are in place around decisions-making – including the reasons and basis on which a decision is made, and the action required to implement a decision

  • providing a record of decisions and actions that will be available for examination by States Members, and Panels and Committees of the States Assembly; the public, organisations, and the media; and as a historical record and point of reference for the conduct of public affairs

Ministers are individually accountable to the States Assembly, including for the actions of the departments and agencies which discharge their responsibilities.

The Freedom of Information Law (Jersey) Law 2011 is used as a guide when determining what information is be published. While there is a presumption toward publication to support of transparency and accountability, detailed information may not be published if, for example, it would constitute a breach of data protection, or disclosure would prejudice commercial interest.

Subject:  Amendment to Road Traffic (Public Parking Places) (Jersey) Order 2006 - Inclusion of 8 Education Sport and Culture car parks with maximum stay periods.

Decision(s): The Minister agreed to amend the Road Traffic (Public Parking Places) (Jersey) Order 2006 and undertook to request Officers to instruct the Law Draftsman to prepare the Amendment.

Reason(s) for Decision: At the request of the Minister for Education Sport and Culture, make Grainville Playing Field Car Park, FB Playing Fields Car Park, Airport Playing Fields Car Park, Les Quennevais Sport Centre and Playing Fields Car Park and Springfield Stadium South Car Park a maximum stay of 12 hours in any continuous 24 hour period, Springfield Stadium East Car Park a maximum stay of 3 hours in any continuous 24 hour period and Val Plaisant Gyratory Car Park a maximum stay of 7 consecutive days.

Resource Implications: Transport and Technical Services Officers and Law Draftsman time.

Action Required: Officers to instruct the Law Draftsman to prepare an Amendment for subsequent submission to the Minister.

TRANSPORT AND TECHNICAL SERVICES  

AMENDMENT TO ROAD TRAFFIC (PUBLIC PARKING PLACES) (JERSEY) ORDER 2006  
 

Purpose of the Report  

To amend waiting time in 8 car parks at the request of the Minister for Education Sport and Culture with maximum stay periods of either 12 hours in any continuous 24 hour period, a 3 hour maximum stay period or 7 consecutive days maximum stay. 
 

Background  

The Education Sport and Culture Minister has requested that the following car parks be included in the Road Traffic (Public Parking Places) (Jersey) Order 2006 with maximum stay periods as detailed to enable policing of the areas to take place.  

The inclusion of these car parks with a maximum stay period will enable the car parks to be policed, therefore this will help to deter long term parking and will enable users of the facilities at the locations to park. The areas have been found to be abused with long term parking when checked by Officers of Education Sport and Culture Department.

Discussion 

Officers support the inclusion of these car parks with the maximum stay periods detailed. The policing and enforcement of this to be carried out by Officers of Education Sport and Culture Department, and the Parishes. 
 

Recommendations 

The Minister is recommended to approve the request from the Minister for Education Sport and Culture and to request Officers to instruct the Law Draftsman to prepare an Amendment to the Road Traffic (Public Parking Places) (Jersey) Order 2006 to incorporate this.

To enable the inclusion of 8 car parks with the detailed maximum stay periods as requested by the Education Sport and Culture Minister.
